Opposition leader Anwar Ibrahim was directly involved in the project to issue citizenship and identity cards to unqualiified immigrants Sabah in the 90s, though without orders from him, claims former prime minister Dr Mahathir Mohamad.
“He normally takes the initiative and sometimes do more (than is required),” said Mahathir at a press conference in Kuala Lumpur today.
“What happens on the ground is often different from the directive (from above).”
Mahathir said that Anwar and the implementing officers on site in Sabah at the time took matters into their own hands and were not necessarily following instructions from the chain of command.
The veteran politician noted that the government had taken action against those officers involved.
He was asked to comment whether he ever ordered Anwar, then his deputy, to issue ICs to unqualified immigrants in Sabah.
“He had a hand in it,” alleged Mahathir adding that what happened may have included illegal action and abuse of process.
The former PM added while he may not have evidence that could be adduced in court, he “has knowledge” of the possible wrongdoings by Anwar.
Asked how a strong PM of a strong government like his could have a deputy and underlings running around not following orders, Mahathir said that even if Superman is PM, he will be hard pressed to be able to look at everything.
He said that he will testify before the royal commission of inquiry (RCI) into illegals in Sabah if called.
“I’ll stick to the facts,” assured Mahathir.
Allegations of Anwar’s involvement in handling the Sabah situation ran rampant when the opposition politicians began to call for an RCI into the immigrant situation in the state.
State BN leaders immediately came out decrying Anwar as the one behind such sheenanigans when he was Mahathir’s deputy, though the allegations were downplayed by the opposition leader.
Both sides however agreed that an RCI was needed, bipartisan pressure made possible the ongoing hearings into allegations that unqualified immigrants were handed out citizenships and ICs by those seeking electoral support from the grateful newly-made citizens.

The National Registration Department (NRD) said today there are some 600 problematic blue identity card numbers that are being shared by more than one person.
“Yes, they are in our records, about 600 of them,” NRD headquarters identity card division director Md Solehan Omar testified at the royal commission of inquiry (RCI) on immigrants in Sabah.
Solehan said this when asked by conducting officer Manoj Kurup as to whether the allegations that more than one person were using the same identity card number were true.
However, Solehan did not elaborate on the matter as neither the conducting officers, nor the watching brief lawyers pressed him on this issue.

NRD: Verification of ‘problematic’ ICs from Sabah ongoing

KOTA KINABALU: The process to verify ‘problematic’ identification cards from Sabah is still ongoing, a senior National Registration Department’s (NRD) officer told the Royal Commission of Inquiry (RCI) on Illegal Immigrants here.
NRD Putrajaya Identification Card Division director Md Solehan Omar said he did not know the details but knew in general that there was issuance of such ICs in Sabah.
He explained ‘problematic’ ICs were those that could not be processed using the normal procedure due to certain problems or missing information in the application forms.
“This included application where the picture submitted does not match with that in the NRD’s record, different fingerprints or name, etc,” he said.
He also confirmed that a special committee had been set up to deal with such applications in Sabah.
He said the panel is chaired by the NRD director-general and its members included himself and several representatives from NRD Sabah and Sarawak.
“The panel carries out investigation, and review all the problematic ICs using the information and materials gathered from Sabah, interview reports and so on to determine the status and background of the applicants.
“The panel meets up and the evidence are brought them to be evaluated,” he added.
Asked how many “problematic” ICs had been investigated and rectified, he said he could not give the actual figure as the operation was still on-going.
To a separate question, Khalid said there should be a unique IC number for every person but there were cases where two or more individuals have the same IC number.
He estimated that there were about 600 such cases.
He also informed the Commission that the mobile operation to register people in rural areas of Sabah was still being carried out by NRD.

KOTA KINABALU: An emotional witness caused a stir and temporary halt to proceedings of the Royal Commission of
Inquiry (RCI) on illegal immigrants in Sabah here when she burst into tears upon hearing the conducting officer talk about her past.

Lung Sim Yee, who was born in Hainan, China, could not hold back her tears when conducting officer Jamil Ariffin asked her to confirm that her father had left them to fend for themselves in China.
She took about five minutes to compose herself before answering Jamil’s question.
“Is it true that your father abandoned his family in China and that when you were 14 years old, your mother applied to the Chinese government for permission to bring you and your sister to Hong Kong to look for your father?” Jamil asked.
“And is it true that when you arrived in Hong Kong, you found out that he has remarried a Malaysian?” he asked and that was when Lung’s tears started flowing.
After composing herself, Lung replied: “Yes.”
She also confirmed that her mother then got a job in a factory and that they lived on her salary and the money that her father sent them.
According to Lung, after three years in Hong Kong, she and her sister travelled to Sabah and went on to stay with their grandparents in Tawau where she met her future husband and got married in 1986.
Lung under Jamil’s questioning also confirmed that she was issued a green identity card in the late 1970s and received a replacement card in 1988.
In 1989, she applied for a MyPR and it was approved, Lung said, adding that her husband had assisted her to apply for a blue identity card.
“I received a letter from Putrajaya in 2010 about my application and went to the National Registration Department in Tawau to take an oath. I also paid a fee of RM300. I then received my blue identity card,” she said adding that she has registered as a voter in 2012.
Lawyer Ansari Abdullah, who is representing Dr Chong Eng Leong, asked Lung if there was any test done on her proficiency in Bahasa Malaysia to which she replied: “I was interviewed in Bahasa Malaysia when I applied for the red identity card.

I, Kong Yun Chee @ Joshua Kong of NRIC 480823-12-5XXX/H0122XXX/H097xxx of x, Lrg xxxxx, Taman xxxxx  Ph x, off Jalan xxxxx, 88000 Kota Kinabalu, Sabah made this affidavit in support/assist the Royal Commission of Inquiry of Illegal Immigrants in Sabah (RCI IIS) under Section 2  Royal Commission of Inquiry Act 1950  (Act 119) to be held in Kota Kinabalu High Court for first sitting on 14th January, 2012.

2.               The RCI IIS was announced by the Prime Minister of Malaysia on 11th August, 2012 and notified in Federal Gazette P. U. (B) 300 dated 21st  September, 2012.

3.               My statement as a witness was recorded at the executive office of  RCI IIS by Supt xxxxxxx in his office at the 4th Floor of Wisma Dang Bandang, Kota Kinabalu on 23rd November, 2012.(SSPA/S/00106/2012).

4.               I would like to claim whistleblower protection under Whistleblower Protection Act 2010 Act 711 for this effort.

5.               I have given my first identity card number issued in the late 1960s of six digits as H097xxx to show others of my presence in Sabah since born in Labuan in 1948.  Many claim they are born in Sabah prior to Malaysia Day on 16th September, 1963, but never have the six digit identity cards, and many also do not have the seven digits identity card number and many only have twelve digits identity cards or MyKad.  All these anomalies should be investigated.

6.          In addition to regularly writing letters and articles to the Press and websites, I have published some books namely EPIC of Sabah  (where EPIC stands for Extra People Identity Cards) in three editions since 2002 and a summary of EPIC of Sabah in another informative booklet –“ Introduction to TSUNAMI of Illegals & Illegalities in Sabah     September 2007 by Joshua Kong at the same time I gave a lecture/talk on this topic at the UiTM’s conference.

6.1      I had also given a talk on the EPIC of Sabah at the University Malaysia Sabah’s premises where the International  Biennial  Conference on Borneo organized by the Borneo Research Council was held in July 2002.

6.2  My first letter on the questioned excessive identity cards issued was published in Daily Express on 16th May, 1987 titled “ICs: we must act positively” and then another important article dated 24th July, 2002 in Daily Express titled “ Up to 1m may have ICs: Ex-candidate” should not have been ignored.

An Indian national testified before the royal commission of inquiry on Sabah immigrants today that he obtained a blue identity card from the National Registration Department (NRD) without providing any supporting document.
Nasir Yusof, who arrived in Sabah in 1982 using an Indian passport, said he heard by word of mouth that the government was giving out blue identity cards to foreigners at the Kota Marudu NRD office.
Responding to conducting officer Jamil Aripin, Nasir said in 1988, he and more than a 100 fellow Indian nationals went in lorries to the Kota Marudu NRD office.

Jamil:
What made you go to the NRD?
Nasir:
I heard that the government was giving out awards (blue ICs)
Jamil: How did you know this?
Nasir:
I heard from my friends.
Jamil: What supporting documents did you use?
Nasir:
None.
Jamil: Not even a statutory declaration?
Nasir:
No.
Jamil: Did you have a birth certificate?
Nasir:
No.
Nasir received his blue identity card within two months of his application. His prior documentation was only an Indian passport.
NONEAs to whether Nasir’s countrymen, with whom he went to apply for the blue identity cards, received theirs or not was not raised.
Nasir said he did not know where the information about the “mass registration” for blue identity card had originated from.
The blue identity card issued to him stated that he was born in Tuaran. It carried a number, with the state code ‘12’, which refers to a local born Sabahan.
He said it was a Kota Marudu NRD officer who decided for him his place of birth.
“When he filled it, he asked me if I was okay with having my birthplace stated as Tuaran. I said okay, because I know the place,” Nasir said.
‘Voted three times’
He said he registered as a voter in 1990 and has since voted three times, the last time in the parliamentary constituency of Sepanggar.
Nasir now runs a business handling work permits for Indian nationals coming to Sabah.
“There are about 20 employers who are my customers. I handle about two to three work passes for each of them… I charge RM100 per person,” he said.
Asked if he was aware that he was being implicated on the Internet for getting blue identity cards for other Indian nationals, Nasir described the allegation as “100 percent defamation”.
“I am a member of the Sabah Malaysian Muslim Indian Congress. I made enemies, which is why they are doing this. My business is also affected,” he said.
Jamil also grilled Nasir on whether he knew anyone in the Sabah Immigration Department from his handling of the work permits, who could be called to testify, but Nasir insisted that he did not know anybody.
A total of 12 witnesses took the stand today. To date, a total of 49 witnesses have testified since the RCI began the first session of its hearing from Jan 14 to Jan 18.
This second session of hearing, which began yesterday, will conclude on Feb 1.

KOTA KINABALU, Jan 30 (Bernama) -- The Royal Commission of Inquiry (RCI) investigating the illegal immigrants problem in Sabah was today told that illegal immigrants sheltered at temporary detention centres in Sandakan were provided with good amenities.

They are given water and electricity supplies, fans, blankets, toilet facilities, and medical care.


Nisa Rahman, the 42nd witness, who testified at today's proceedings, said she lived in a block which catered for about 100 women doctor and a doctor visited them once a week.


The 30-year-old witness said she came to Tawau from Sulawesi, Indonesia with 10 immigrants in October 2011 before being taken to Sandakan without being checked by the authorities.


Nisa, who worked at an oil palm plantation in Sandakan and paid RM100 a month, was caught on Dec 9 last year by the Immigration Department while walking in Sandakan as she had no identification documents.


To a question from conducting officer Jamil Aripin, Nisa said she did not know when she would be deported.


Earlier, the 41st witness, Degon Amy, 23, from Tawi-Tawi, the Philippines, who lived in a block housing about 170 detainees, said he came to Sabah in 2002 at the age of 13 and was arrested two years later while working as a bus conductor.


The 38th witness, Lung Sim Yee, from China, who testified in Mandarin, said she was married to a Malaysian in 1986 and had applied for citizenship and a blue identity card at the National Registration Department.


Lung, who cried uncontrollably earlier, said she, her mother and her younger sister came to Tawau to track down her father and she registered as a voter last year.


Rasad Salleh from the Philippines, who came to Sandakan in 1979, said he was among 666 immigrants who lived in the Kampung Tongkang resettlement scheme which was provided with water and electricity supply and a religious school for children.


There were 112 houses in the scheme and the immigrants there were provided with IMM-13, the identification documents issued the Filipino refugees, he added.


On the other hand, Waja Atik, who lived in the Pulau Berhala resettlement scheme in Sandakan since 1980, said the immigrants there had no electricity and water supplies and had to rely on wells and generators.

PENAMPANG: Foreigners being granted Malaysian citizenship should go through a more stringent process such as that practised in other countries like Australia and the United States of America.
“I saw a very nice picture of the Australian Prime Minister giving citizenship to an individual on Australia Day recently, and this individual had to recite the national anthem during a special ceremony. So things like that should be done properly with certain procedures so the citizenship will be more meaningful.
“How can there be meaning to a citizenship when you just become one overnight or given to just about anybody else on very dubious considerations?” the United Pasokmomogun KadazanDusun Murut Organization (UPKO) president asked.
Dompok, who was met at a meet the people session at Kampung Terawi on Sunday night, was also asked if he thought opposition leader Datuk Seri Anwar Ibrahim should be subpoenaed to give evidence to the Royal Commission of Inquiry on the presence of illegal immigrants in Sabah.
He replied: “I think the RCI must be a commission of inquiry that looks into finding out what happened, to find a solution and if indeed Anwar Ibrahim has something to say, then he should be called.
“But he does not appear to be someone who has something to say because he has said he knows nothing about it. So I do not see any angle why he would volunteer himself to be called – but then again it is up to the RCI to find out,” the Penampang member of parliament said.
To the question whether he thought former Prime Minister Tun Dr Mahathir Mohamad should also be subpoenaed, Dompok said it would be up to the Royal Commission of Inquiry.
“I would not know, that will be up to the RCI.”
When it was pointed out to Dompok that Mahathir had said that foreigners who qualified have been given Malaysian citizenship, the former said: “I suppose the avenue for him to expand on his statement could be the RCI if he wants but it is not for me to say.
“It is up to the RCI whether to subpoena him or for Mahathir to volunteer to go. It is really up to them; I don’t think I have much to say about that,” he added.
Dompok who was asked on what he thought of Mahathir saying it was right to give citizenship to foreigners, replied: “I am of the view that giving citizenship to people must follow the procedures that have been set. It cannot be done just by giving to anybody at any time that you like. There must also be some qualifying period for the procedures.”
On the issue of whether the issuing of citizenship to about 200,000 foreigners was within the law, Dompok said he would not be able to comment on the matter.
“I don’t think I would be able to say whether it is within the law or not because you have to check who these people (who were given citizenship) are. That is why we have the RCI because obviously we are not able to get these details. I have tried it before – I have tried it in parliament when I was the chairman of the Parliamentary Select Committee on Integrity. I tried to inquire deeper into this issue but I could not.
“I am very happy that the RCI has been set up so people can then ask and anybody subpoenaed must come,” he said.
When asked if BN’s support would be affected now that the RCI has been told that phantom voters had been used to help the coalition win in several constituencies in Sabah, Dompok was of the opinion that support for BN would remain strong.
“This is therefore the time to support BN because we have a new leadership that is not afraid to tackle issues; even setting up the RCI. The people of Sabah should be thankful that we have a brave government that is willing to take risks in order to solve problems.
“That is all the more reason why we should support (BN) and I see no reason for BN votes to decrease on account of what it is doing for the good of the country; it would not make sense,” he stressed.
He also took opposition leader Lim Kit Siang and Sabah DESAH chairman Tan Sri Simon Sipaun to task for having said they have no confidence that the BN government would solve the illegal immigrant issues.
“That is what they said, they said the RCI will be still-born, it won’t even see the light of day; it saw the light of day. After it was basking in the sunlight, they said ‘oh nothing will come out of it’, then the Pakistanis came to testify then they are now saying the government will not do anything.
“So wait, give BN a thumping victory and we will prove what we can do,” he said.

KOTA KINABALU, Jan 29 – A then-Sabah National Registration Department (NRD) director sold 16,000 NRD receipts for more than RM1million that enabled immigrants in Sabah to vote, the Royal Commission of Inquiry (RCI) on illegal immigrants heard today.
Special Branch (SB) officer DSP Badaruddin Ismail, who works in Kelantan, testified today that Ramli Kamarudin sold each receipt for RM250 between 1993 and 1995 to illegal immigrants from the Philippines, India, Pakistan and other countries.
“He (Ramli) said he just did it for the money,” Badaruddin told the RCI here today.
Badaruddin, who had interrogated Ramli, stressed that Ramli said he had done so on his own accord for personal gain without instructions from higher authorities.
Ramli, however, told the RCI recently that then-Deputy Home Minister, the late Tan Sri Megat Junid Megat Ayub, had ordered him to issue NRD receipts, which matched the names and IC numbers of registered voters, to immigrants.
Ramli has said that about 200 NRD receipts were issued in five or six state constituencies, which the government considered difficult to win, before the 1994 state election.
The 1994 state election saw Parti Bersatu Sabah (PBS) winning just 25 out of 48 state assembly seats.
But several PBS MPs defected to Barisan Nasional (BN) shortly after, causing the collapse of the PBS government.
Ramli said that he had used some of the RM1million for personal matters and distributed the rest to his officers and to organise a sports festival in Penang for his subordinates, according to Badaruddin.
The SB officer added that Ramli distributed 14,000 NRD receipts among the latter’s subordinates to be issued to immigrants, while 2,000 receipts were personally issued by Ramli to certain people.
Another then-Sabah NRD director called Datuk Abdul Rauf Sani had sold 6,305 identity cards to Filipino and Indonesian immigrants, as well as locals, for RM167,300, Sarawak SB chief Datuk Haji Ibrahim Zakaria told the RCI earlier today.
Ibrahim added that 94 people, including 24 NRD officials, were arrested under the Internal Security Act (ISA) from 1994 to 2000 for issuing identity cards in Sabah illegally.
“No, he (Rauf) did not say that he acted upon instructions, but he acted on his own,” said Ibrahim.
“From the intelligence I gathered, it is more for gaining rewards, profit,” added Ibrahim, who was wearing a black suit and red tie.
Asked if Ibrahim believed that Rauf was acting on his own, Ibrahim said: “He’s an intelligent person, educated overseas, very communicative, a certain level of position in government service. I took what he said as the truth.”
Rauf, however, told the RCI recently that blue identity cards were also issued to increase the number of Muslim voters in Sabah.
He has said he was aware that immigrants in Sabah were taught how to vote in elections, otherwise their identity cards would be cancelled.
Former Sabah NRD assistant registrar Kee Dzulkifly Kee Abd Jalil testified recently that 100,000 blue identity cards were given to Filipino, Indonesian and Pakistani immigrants in Sabah in 1993.
Tun Dr Mahathir Mohamad, Malaysia’s longest-serving prime minister who was in power from 1981 to 2003, has been accused of spearheading the so-called “Project IC”, in which citizenships were allegedly given to immigrants for their votes.
But former Sabah Chief Minister Tan Sri Harris Salleh, who administered the state from 1976 to 1985, has denied at the RCI the existence of “Project IC”.
Dr Mahathir told a recent press conference that foreigners in Sabah had indeed received citizenship, but stressed that it was “within the law”.
The inquiry before former chief judge of Sabah and Sarawak Tan Sri Steve Shim Lip Kiong resumes tomorrow.

Tawau: The Government will act on any report or resolution by the Royal Commission of Inquiry (RCI) on Illegal Immigrants in Sabah, said Attorney-General Tan Sri Abdul Gani Patail.
In giving this assurance, he said, where there were criminal elements involved, action would be taken, and wrongs would be righted.
"Yes, if there are criminal offences, we will act. This is the Government's promise. That is why, the RCI was set up.
"However, we must remember, if we talk about criminal prosecution, we have to see whether there is sufficient evidence. In the RCI, everything that people say is acknowledged, but without evidence, we cannot accept.
We can accept hearsay evidence.
"To enable us to go to court, we have to look at admissible evidence.
This is not an excuse not to take action against those who committed a crime. We will take action, but according to the law," he told reporters after attending the Opening of the Legal Year 2013 at the Tawau Court, here, Monday.
Also present at the event were Chief Justice of Malaysia Tun Arifin Zakaria, Court of Appeal President Tan Sri Md Raus Sharif, Federal Court Judge Tan Sri Abdull Hamid Embong and Chief Judge of Sabah and Sarawak Tan Sri Richard Malanjum.
Abdul Gani also urged all parties to have confidence in the RCI which he said, had delved extensively into all issues which were exposed.
"Everyone knows, that many were arrested (including) those with identity cards. This shows that the government is transparent. Looking at another aspect, it is a promise fulfilled.
"The Prime Minister (Datuk Seri Najib Tun Razak) had said he would see to it that an RCI would be set up, and that it would be transparent and reliable.
Otherwise, all these issues would not have been exposed.
"And, I am very glad and happy with it because that is what we want.
Why, because the truth must come out exactly as it is," he said.
Abdul Gani said, a mistake could have been committed earlier, and that mistake was being investigated, whether it was committed by government officers or the Government itself, or there was an element of fraud or corruption, which should be resolved for everyone's satisfaction.
"And, that mistake, we have to rectify...it is very important for this State (Sabah), it's my State.
We must do something. So, don't be in a haste, let's wait and see, just allow the RCI to do its job effectively," he said.

Kota Kinabalu: Sabah Reform Movement Chairman Datuk Wilfred Bumburing has challenged Datuk Salleh Tun Said and all former Chief Ministers of Sabah to appear before the Royal Commission of Inquiry (RCI) on illegal immigrants in Sabah to give testimony.
He issued the challenge as Pakatan Rakyat leader, Datuk Seri Anwar Ibrahim, had declared that he was prepared to appear before the RCI.
"All of them are duty-bound to help solve the problem.
Those who refuse to do so will imply that they are cohorts to former Prime Minister Tun Dr Mahathir Mohammad's misdeed," he said here, Monday.
Bumburing, who is also Tuaran MP, said the magnitude of the illegal immigrant problem today in Sabah was a result of a well-planned programme by the Umno-led BN government since the day Mahathir took power. [JK says Project IC goes back to USNO time]
"The problem had been raised by the people of Sabah since the 80s but the Federal Government had taken a hard line position of denial.
"Mahathir was forced to eventually admit that he was indeed responsible for the issuance of ICs to the illegal immigrants in Sabah.
"Indeed, Mahathir stands accused of committing an act of betrayal to the people of Sabah and country for failing to protect the sovereignty of Sabah within Malaysia by giving citizenship to a large number of foreigners," he said.
Bumburing claimed that when his (Mahathir) misdeed had eventually been exposed, he scrambled for excuses and justification for his act.
"He had the guts to say that his action is justified by saying that he acted according to the law. The facts had now been revealed through the hearing of the RCI and now the Federal Government is duty-bound to review all the ICs given illegally to prove whether Mahathir had acted according to the law.
"By saying that Tunku Abdul Rahman had acted worse than him in granting a million foreigners citizenship is admission on the part of Mahathir that his action was wrong.
"However, he had erred in his analogy because the granting of citizenship to the migrant population at the time of independence was the agreement between the various races then based on the social contract that the three major races agreed upon.
"Mahathir forgot that his father was also a beneficiary of the agreement.
Mahathir should be brought to a constitutional court for his grievous misdeed to the people and country," he said.
Towards this end, Bumburing asked Salleh the reason he did not challenge Mahathir to appear before the RCI after his admission to his part in issuing ICs to the illegal immigrants in Sabah.
"By not doing so I dare to say that he condones all what Mahathir had done to the great injury to the people of Sabah.
"I also would like to ask Salleh what he had done during his tenure as the Chief Minister of Sabah to solve the illegal immigrant problem," he said.

An Indian national obtained Malaysian citizenship from the Sabah National Registration Department (NRD) by simply using a false statutory declaration, the royal commission of inquiry into Sabah immigrants was told today.
Nur Mohd Ibrahim, who hails from Tamil Nadu, India, said he entered Sabah in 1981 and soon after applied for a blue identity card on the urging for his Filipino colleagues at a restaurant.
However, his first round of application using a false SD was rejected.
In 1983, he tried his luck again, using the same method, and was subsequently granted a blue identity card. This was merely two years after he had set foot on Malaysian soil.
The SD stated that Nur Mohd was born in Kinarut, Papar.
Nur Mohd told the RCI that he registered as a voter in 1991 – eight years after he became citizen of Malaysia. According to him, he had voted four times in the state seat of Likas.
In 2001, the Election Court ruled that former Sabah chief minister Yong Teck Lee’s victory in Likas null and void due to the prevalent of illegal immigrants in the electoral roll.
Yong won the seat at the Sabah 1999 state election and the results was challenged by two defeated candidates.
Then High Court judge Muhammad Kamil Awang, who revealed he was pressured by his superiors to dismiss the application, said in his judgment:
“The instances of non-citizens and phantom voters in the electoral roll as disclosed in this trial may be the tip of the iceberg.
“It could not be denied that the registration of voters in the Likas electoral roll was in contravention of the law. No one including the government department is above the law.”

'Sabah chief minister is ... Mahathir'
Nur Mohd said the SD he used had been drafted by a commissioner of oaths in Kepayan and his Filipino friends taught him to list a place in Sabah as a his birth place.
"Even though I got my blue identity card, I was scared to use it because I was not sure if it was valid or not until I registered as a voter in 1991," he said.
Queried by conducting officer Jamil Aripin if he knew this was tantamount to cheating the NRD, Nur Mohd remained silent.
He then proceeded to test the witness' knowledge of Malaysia, and Nur Mohd managed to name the three most recent prime ministers without trouble.
However, when asked who the chief minister of Sabah is, he replied: "Mahathir" before withdrawing his statement as he invited giggles around the room.
It is unclear if Nur Mohd's identity card was part of any illegal operation but the NRD rules were relaxed in the 1980s to accept SDs as identification documents in applications for blue identity cards.
This rule was abolished in 1987, and since then, only birth certificates have been accepted.

KOTA KINABALU: The State Reform Party (Star) has challenged local parties in Sabah to leave the Barisan Nasional (BN) in the wake of former Prime Minister Mahathir Mohamad’s widely-reported blog posting on Wednesday this week that “illegal immigrants who have stayed long in Sabah are entitled to citizenship especially when they can speak Bahasa Malaysia”.

He also called for the removal of illegal immigrants holding MyKads meant for citizens by operation of law from the electoral rolls.


Police urged to charge Mahathir with treason


Thirdly, Daniel urged the Police to interview Mahathir and charge him in Court over his blog posting “which is tantamount to an admission of sedition and treason”. He’s not in favour of the Federal Government recommending to the King that Mahathir be given any Royal Pardon by the backdoor.

Fourthly, he urged the formation of an Interim Federal Government composed of all parties across the political divide to draw up a long-delayed Federal Constitution for Malaysia. He pledged to set up a Constitution for Malaysia Movement (CoMaMo) shortly to embark on a signature campaign. 

He claimed that Malaysia was supposed to get a Constitution in 1963 but instead the Malayan Constitution has been allowed to masquerade as the Malaysian Constitution “because the Federation of Malaya is masquerading as the Federation of Malaysia.”


BN parties in Sabah in morally untenable position


“BN parties in Sabah are in a morally untenable position after Mahathir’s statement which was made to pre-empt the imminent Royal Commission of Inquiry (RCI) in Sabah,” said Star deputy chairman Daniel John Jambun in a press statement after an emergency meeting here of Borneo’s Plight in Malaysia (BoPi MaFo), an NGO pending registration in the United Kingdom to strategize with Hindraf Makkal Sakthi on a class action suit.


“Mahathir’s blog posting proves that he was involved in Projek IC Mahathir to give out MyKads meant for citizens by operation of law to illegal immigrants in Sabah.”


Daniel challenged BN parties in Sabah to make their stand on Mahathir’s blog posting one way or other especially in view of the imminent RCI on illegal immigrants.


Mahathir wants to urge illegals to vote for BN


Mahathir also wants to give comfort to the illegal immigrants and urge them to vote for BN after Anwar Ibrahim’s recent statement on the issue, he added. “Anwar warned illegal immigrants to stay out from the voting process if they don’t want to be deported when Pakatan Rakyat forms the Federal Government in Putrajaya.”


The Star deputy chairman stressed local parties in BN Sabah cannot “have their cake and eat it too”.


They need to either uphold the Federal Constitution or admit that they have been going along since 1981 with Mahathir’s Law of the Jungle, he added.


The Federal Constitution, pointed out Daniel, is crystal clear on the eligibility for citizenship in Malaysia.


“In the case of Sabah, illegal immigrants are being provided with local birth certificates to claim MyKads meant for citizens by operation of law,” alleged Daniel. “We only have to look at the cases of Pakistani carpet dealer Salman Majid and Indian restaurant keeper Majid Kani to realise that these are the tip of the iceberg.”


Mahathir admits involvement in Projek IC Mahathir


The Projek IC Mahathir, continued Daniel, gave out local birth certificates to illegal immigrants based on them making out false Statutory Declarations claiming that the applicants were born in Sabah.


“These twice-born people subsequently obtained MyKads meant for citizens by operation of law,” he said. “Majid Kani admitted in Court that he was born in Tamil Nadu, India and not in Papar, Sabah. Salman Majid said that he was not in Sabah for the first 23 years of his life and that he holds documents (false) showing that he was born in Sabah.”


Anyone, he said, can Google these cases.


The mystery, according to him, was how Salman Majid and Majid Kani obtained their first MyKad without having to produce the personal documents of their parents.


“Malaysians have to produce their parents’ personal documents when they apply for their MyKad for the first time,” stressed Daniel. “Everyone including a 12 year old kid knows this.”


Sabah, Sarawak have rights, powers on citizenship


Pointing out the law as it applies to Sabah, as in Sarawak, Daniel explained that the Federal Government cannot give out citizenships to foreigners in the state without the recommendation of the state government as the initiating party on a case-by-case basis.


According to him, this is provided for by the five constitutional documents and/or conventions which formed the basis for Sabah and Sarawak to be in Malaysia.


If eligible foreigners in Sabah have been naturalized by the Federal Government without the prior recommendation of the state government as the initiating party, said Daniel, “they would have to apply for permanent residence to be considered Sabahans.”


“Here, we are talking about foreigners who have entered the state with valid travel papers, stayed at least 10 years or more within 12 years and have gone through the legal procedures including police clearance by the Special Branch and by the police in their home countries,” said Daniel. “Mahathir is talking about illegal immigrants circumventing the Federal Constitution with Putrajaya and the state governments in Sabah and Sarawak looking the other way.”


Foreigners not eligible for operation of law, registration


Foreigners, stressed Daniel, are not eligible for citizenship by operation of law or registration but only by naturalization.


Illegal immigrants, he further stressed, are not entitled to anything no matter how long they have stayed in the country and no matter how well they speak Bahasa Malaysia. He urged that such illegal immigrants and their children be deported by the backdoor, if not by the front door.


“If they came in by the backdoor, they should go back by the backdoor since there’s no record of their having legally left their home countries,” said Daniel.


On illegal immigrants who came in by the front door and became illegal immigrants after over-staying and either have expired or valid papers, he urged that they be urged to return by the front door if their home countries will not declare them as stateless people, and by the back door if they have since lost their citizenship rights back home.


“Such people should take their children along too and not leave them behind to wander in the streets in Sabah,” said Daniel. “We are the poorest state in Malaysia today after being conned into the Federation by the British and the Malayans and cannot afford to look after them.”


General Amnesty best way forward for illegals in Sabah


Asked whether there was any hope for the illegal immigrants in Sabah on humanitarian grounds, Daniel softened a little and conceded that a general amnesty could be offered to those people who surrender their Malaysian personal documents obtained by misrepresentation and/or fraud, pay a fine of at least RM 300 each as in 1965 in Peninsular Malaysia, remove their names from the electoral rolls, return to their home countries either by the front or backdoor and re-enter legally if they had jobs in Sabah and wished to resume from where they left.


The Star deputy chairman urged the Federal Government to offer the general amnesty either before the imminent RCI convenes or completes its work.


“It would be better if the general amnesty is offered before the 13th General Election since many of these illegal immigrants are on the electoral rolls, he claimed. “Many of them are even in the state assembly, Parliament and in Government including Sabah Foundation and the Land Office and holding positions in state and Federal GLCs.”

   
Going forward, Daniel vowed to compile Mahathir’s blog posting on urging citizenship for illegal immigrants and the related reactions in the media to present to the RCI as proof of Mahathir’s complicity in Projek IC Mahathir and his guilt acknowledged in the Court of Public Opinion.

At least RM3,000 each   and the money should come to Sabah as the destruction is much more in 40 years.

We should also negotiate with countries concerned, for at least RM1b per year hence RM40b is more appropriate.

We need the money to re-construct Sabah and the lives of the Sabahans for those heinous violations etc.....

Whoever cause the damages, they have to pay.. RIGHT.
