‘Probe Mahathir’s citizenship’

Leven Woon | February 2, 2013

A PKR leader said Mahathir was half Indian, so he and his ancestors might have obtained their citizenship through illegal means.
KUALA LUMPUR: Former Prime Minister Dr Mahathir Mohamad should have his citizenship probed by the authorities, if he thinks that the granting of citizenship to Chinese and Indian prior to independence was wrong , said a PKR leader.
R Suresh Kumar, the special assistant to Opposition Leader Anwar Ibrahim, said this was because Mahathir was also a half Indian whose ancestors were given citizenship to become Malayan at that time.
“The full name of Mahathir is Mahathir Mohd Iskandar Kutty. The word Kutty suggests that his dad was an Indian Muslim.
“If he is questioning the granting to citizenship to Indians and Chinese before independence, then his ancestors must be investigated too. And also his own citizenship,” he said at a protest rally against Mahathir in Brickfields today.
Last month, the former premier said the granting of citizenship to Sabah immigrants during his tenure could be equated to the same policy by Malaysia’s first Prime Minister Tunku Abdul Rahman to Indian and Chinese immigrants prior to Independence.
He claimed that Tunku has awarded citizenship  even though it was not provided in the law at that  time.
“This situation came about because the Malays are generous and prepared to dilute their power, and this is very different from what happened in Sabah because they had the right to have citizenships,” he added when asked to comment on the criticisms against him regarding the granting of citizenship to immigrants in Sabah.
Various opposition leaders have since condemned Mahathir’s statements and labelled it  as inappropriate and misleading, while MCA chief Dr Chua Soi Lek said he was unsure whether Mahathir was saying that in jest or not.
Today, a group of 60 people from various NGO and political parties staged a 30-minute protest at the elephant fountain in Brickfields against Mahathir.
Holding up banners bearing Mahathir’s portraits with the captions “The nation’s traitor”, “The biggest liar”, “the most insulting individual”, they demanded an apology from the former premier within a week.
The group later lodged a police report against the Mahathir for uttering seditious statements.
Tamil Action Force deputy secretary Kannan Ramasamy pointed out that Mahathir’s claims was a non-issue because all British colonies that time had given citizenship to non-natives based on jus soli principle.
Jus soli is a right by which nationality or citizenship can be recognized to any individual born in the territory of the related state.
“A total of 42 commonwealth countries including Sri Lanka and  Jamaica have done this,” he said.
Kannan said in contrast, Mahathir’s granting of citizenship to Sabah immigrants was for the latter’s political survival because the then state ruling party, Parti Bersatu Sabah had pulled out from BN on the eve of General Election 1990.
“BN was left in lurch in Sabah because PBS joined (Tengku Razaleigh-led) Semangat 46. (Then Deputy Prime Minister)  Ghafar Baba was sent to Sabah to form Umno. But there was only 7.9 percent Malays in Sabah that time. So Mahathir began to give out citizenship to make sure he got enough Umno members.
“Today, Sabah Umno has got the largest membership as compared to other states,” he claimed.
Malaysia Indian Progressive Association’s (MIPAS) AP Raja Retinam  questioned the logic to grant citizenship to the Philippines Muslim whom,  in contrary to the pre-Independence Indian or Chinese, did not contribute to the country.
“Indians built the first road and railway. Don’t insult us by comparing us with the war refugees and illegal immigrants from Philippines in Sabah,” he said.
He said a huge rally would be held on Feb 23 at 6pm in KL and Selangor Chinese Assembly Hall to press Mahathir to retract his statement and apologise.
Meanwhile, MIPAS secretary-general S Barathidasan urged the authorities to revoke Tunship granted to Mahathir, saying that the former strongman was not fit to be a Tun

71. IGP must investigate electoral roll fraud now

Is anything done since early February 2013 by IGP?  Lies cannot go on any longer!!!! Joshua

IGP must investigate electoral roll fraud now

COMMENT The South African Institute for Race Relations report says there are 42,000 people over the age of 100 and some over 120 years old in the voters roll of Zimbabwe.
This is a country with a life expectancy of 43 years.
But still Tobaiwa Mudede, the equivalent of Malaysia’s Election Commission (EC) chairperson, claims that no fraud had ever been practiced in preparing Zimbabwe’s electoral roll.
In comparision, at the Sabah RCI on illegal immigrants, a former NRD officer Mohd Nasir Sugip, revealed in ‘Ops Durian Buruk’ that he and others processed some 40,000 application forms for blue identity cards which signify Malaysian citizenship.
NONEThese were meant to be distributed to immigrants in Sabah, believed to be in exchange for votes.
They were based in the house of Abdul Aziz Shamsuddin, the then-political secretary to then premier Dr Mahathir Mohamad (right).
Yet, our EC chairperson, in April 2012, claimed that “no other country in the world has a cleaner electoral roll than ours”.
The most prevalent issues in Zimbabwe’s electoral roll are the issuance of instant or faked personal identification papers and fictitious addresses.
We are facing exactly the same problem.
Similar game plan
Mudede is believed to have started his shenanigans sometime in 1980.
From the revelations made during the Sabah RCI we can say that the game here started about the same time or slightly earlier and came to its peak in the 1990s during Ops Durian Buruk.
I do not know if it was our EC which copied Mudede’s methods or the other way round, or both coincidentally shared the same ideas.
However if the Zimbabweans could still get together to challenge Mudede’s roll in spite of them having to face more dangerous and threatening circumstances than what we face, we should be able to do better if we all challenge the EC’s roll together.
I last week suggested that the Selangor state government take up the task by challenging the gazette instead of challenging the roll head-on.
Silence of the IGP
I am really puzzled as to how the inspector-general of police (IGP) has been able to remain silent without stating his position since the start of the Sabah RCI more than two weeks ago.
The issue has escalated into a personal vendetta between Mahathir and opposition leader Anwar Ibrahim since two days ago.
NONEAlthough Mahathir and Anwar (left) have both declared their willingness to testify before the RCI if called, it must be made clear that their testimonies will not bring any changes to the already tainted electoral roll.
The IGP and attorney-general Gani Patail, in particular, must be bold and frank enough to explain to citizens that evidence given by witnesses in a RCI, is not admissible in any civil or criminal proceedings whatsoever against the person who gave the evidence, except when the person is charged with giving false evidence. That’s all. (Section 11 RCI Act 1950.)
The RCI chairperson is not like a judge who is empowered to pronounce a verdict whether a person is guilty of an offence or not.
NONENor can the chairperson decide to institute, conduct or discontinue a criminal proceedings like an AG can.
Citizens at the moment seem to have high expectations that action will be taken against those perpetrators or masterminds once the RCI concludes its enquiry.
The citizens must be told of the RCI’s actual mechanism. They should not continuously be deceived nor given false hopes like what Gani Patail (right) did a couple of days ago, saying that he will do something when the RCI is concluded, especially so since Sabah is his home state.
Gani should inform the rakyat that even he as the AG cannot charge a person with any criminal offence based solely on a RCI report.
He has to rely on an investigation paper put up by a proper investigative body such as the police or the MACC depending on the nature and classification of the crimes committed and the laws applied.
NONEBoth Gani and I have gone through this process before in the 1998 ‘black-eye’ incident involving Anwar and then-IGP Rahim Noor (left).
Even though the former IGP’s admission was recorded during the RCI established to investigate that incident, the AG had to rely on my investigation papers and what I had recommended when charging Rahim Noor.
It was not based on the RCI final report or its recommendations.
That’s the reason why I am harping on the IGP to commence investigations right away and not wait for the completion of the Sabah RCI before deciding on his next course of action.
I am making this suggestion based on my experiences and the laws and not at my whim and fancy.
Dr M and Anwar can volunteer
As for Mahathir and Anwar, who are in some ways implicated in the Projek IC, both of them are entitled to be represented by their own advocates at the inquiry after getting leave from the commissioners. Both Mahathir and Anwar do not have to wait to be called. They can take their own initiatives to appear before the RCI. This is provided for under Section 18 of the RCI Act 1950.
I am sure both of them are familiar with this rule, especially since both had been involved in some way in the black eye incident RCI.
There’s no need for either of them to declare their willingness to testify at the Sabah RCI only through the press. If they are sincere and have nothing to hide, or if they are not involved at all, then they should put in their bid to be represented at the RCI at the next hearing date.
They can also apply to have their testimonies given through a statutory declaration. That method is easier. There are many ways to do it, if they really want it done.

Anwar directly involved in Project IC, says Dr M

Opposition leader Anwar Ibrahim was directly involved in the project to issue citizenship and identity cards to unqualiified immigrants Sabah in the 90s, though without orders from him, claims former prime minister Dr Mahathir Mohamad.
“He normally takes the initiative and sometimes do more (than is required),” said Mahathir at a press conference in Kuala Lumpur today.
“What happens on the ground is often different from the directive (from above).”
Mahathir said that Anwar and the implementing officers on site in Sabah at the time took matters into their own hands and were not necessarily following instructions from the chain of command.
The veteran politician noted that the government had taken action against those officers involved.
He was asked to comment whether he ever ordered Anwar, then his deputy, to issue ICs to unqualified immigrants in Sabah.
“He had a hand in it,” alleged Mahathir adding that what happened may have included illegal action and abuse of process.
The former PM added while he may not have evidence that could be adduced in court, he “has knowledge” of the possible wrongdoings by Anwar.
Asked how a strong PM of a strong government like his could have a deputy and underlings running around not following orders, Mahathir said that even if Superman is PM, he will be hard pressed to be able to look at everything.
He said that he will testify before the royal commission of inquiry (RCI) into illegals in Sabah if called.
“I’ll stick to the facts,” assured Mahathir.
Allegations of Anwar’s involvement in handling the Sabah situation ran rampant when the opposition politicians began to call for an RCI into the immigrant situation in the state.
State BN leaders immediately came out decrying Anwar as the one behind such sheenanigans when he was Mahathir’s deputy, though the allegations were downplayed by the opposition leader.
Both sides however agreed that an RCI was needed, bipartisan pressure made possible the ongoing hearings into allegations that unqualified immigrants were handed out citizenships and ICs by those seeking electoral support from the grateful newly-made citizens.

600 IC numbers being shared, RCI told

The National Registration Department (NRD) said today there are some 600 problematic blue identity card numbers that are being shared by more than one person.
“Yes, they are in our records, about 600 of them,” NRD headquarters identity card division director Md Solehan Omar testified at the royal commission of inquiry (RCI) on immigrants in Sabah.
Solehan said this when asked by conducting officer Manoj Kurup as to whether the allegations that more than one person were using the same identity card number were true.
However, Solehan did not elaborate on the matter as neither the conducting officers, nor the watching brief lawyers pressed him on this issue.

NRD: Verification of ‘problematic’ ICs from Sabah ongoing

Posted on February 1, 2013, Friday
KOTA KINABALU: The process to verify ‘problematic’ identification cards from Sabah is still ongoing, a senior National Registration Department’s (NRD) officer told the Royal Commission of Inquiry (RCI) on Illegal Immigrants here.
NRD Putrajaya Identification Card Division director Md Solehan Omar said he did not know the details but knew in general that there was issuance of such ICs in Sabah.
He explained ‘problematic’ ICs were those that could not be processed using the normal procedure due to certain problems or missing information in the application forms.
“This included application where the picture submitted does not match with that in the NRD’s record, different fingerprints or name, etc,” he said.
He also confirmed that a special committee had been set up to deal with such applications in Sabah.
He said the panel is chaired by the NRD director-general and its members included himself and several representatives from NRD Sabah and Sarawak.
“The panel carries out investigation, and review all the problematic ICs using the information and materials gathered from Sabah, interview reports and so on to determine the status and background of the applicants.
“The panel meets up and the evidence are brought them to be evaluated,” he added.
Asked how many “problematic” ICs had been investigated and rectified, he said he could not give the actual figure as the operation was still on-going.
To a separate question, Khalid said there should be a unique IC number for every person but there were cases where two or more individuals have the same IC number.
He estimated that there were about 600 such cases.
He also informed the Commission that the mobile operation to register people in rural areas of Sabah was still being carried out by NRD.

Emotional witness causes temporary halt to RCI proceedings

Posted on January 31, 2013, Thursday
KOTA KINABALU: An emotional witness caused a stir and temporary halt to proceedings of the Royal Commission of
Inquiry (RCI) on illegal immigrants in Sabah here when she burst into tears upon hearing the conducting officer talk about her past.

Lung Sim Yee, who was born in Hainan, China, could not hold back her tears when conducting officer Jamil Ariffin asked her to confirm that her father had left them to fend for themselves in China.
She took about five minutes to compose herself before answering Jamil’s question.
“Is it true that your father abandoned his family in China and that when you were 14 years old, your mother applied to the Chinese government for permission to bring you and your sister to Hong Kong to look for your father?” Jamil asked.
“And is it true that when you arrived in Hong Kong, you found out that he has remarried a Malaysian?” he asked and that was when Lung’s tears started flowing.
After composing herself, Lung replied: “Yes.”
She also confirmed that her mother then got a job in a factory and that they lived on her salary and the money that her father sent them.
According to Lung, after three years in Hong Kong, she and her sister travelled to Sabah and went on to stay with their grandparents in Tawau where she met her future husband and got married in 1986.
Lung under Jamil’s questioning also confirmed that she was issued a green identity card in the late 1970s and received a replacement card in 1988.
In 1989, she applied for a MyPR and it was approved, Lung said, adding that her husband had assisted her to apply for a blue identity card.
“I received a letter from Putrajaya in 2010 about my application and went to the National Registration Department in Tawau to take an oath. I also paid a fee of RM300. I then received my blue identity card,” she said adding that she has registered as a voter in 2012.
Lawyer Ansari Abdullah, who is representing Dr Chong Eng Leong, asked Lung if there was any test done on her proficiency in Bahasa Malaysia to which she replied: “I was interviewed in Bahasa Malaysia when I applied for the red identity card.

Quote "when she burst into tears upon hearing the conducting officer talk about her past."
why talk of personal past?
