KOTA KINABALU: The National Registration Department (NRD) is proposing an amnesty for thousands of foreigners in Sabah who might have obtained the Malaysian citizenship and identity cards by falsifying their particulars.

NRD director-general Datuk Jariah Mohd Said told the Royal Commission of Inquiry on Sabah’s illegal immigrant problem that the government could consider awarding citizenship to these foreigners, many of whom had been living in Sabah for more than 30 years.

"The citizenship could be given to them under Article 19(2) of the Constitution," she said to a question from the conducting officer, Manoj Kurup.

"What is important is that the records in the department are corrected,” Jariah said, adding that many of the foreigners had married and have settled down in Sabah and had children and grandchildren here.

She said those who refused to step forward during the amnesty would be tracked down and their identity cards and citizenship revoked.

“Those involved must own up to their mistake and regularise their stay in Sabah. This is a long-standing matter,” Jariah added.

The Commission earlier heard that the issuance of high security identity cards containing the bunga raya logo or other documents through dubious means in Sabah was carried out over three phases.

The first, dubbed P1, was done between 1979 and 1984, involving 51,300 documents. Jariah explained that most of these had complete supporting documents such as statutory declarations that the NRD kept.

The second phase, P2, was carried out between 1984 and 1988 involving the issuance of 62,550 documents. Jariah said many of these were incomplete as they did not have any supporting documents.

The third phase, P3, which was carried out between 1990 and 1996 involved the issuance of 16,699 temporary identity card which have since been revoked.

To another question from Manoj, Jariah said only 8,887 holders of the “bunga raya” identity cards issued under the P1 and P2 phases had applied to change to the MyKad.

She said after vetting by a special committee headed by her at the NRD headquarters in Putrajaya, only 3,065 applications were approved.

Asked by Manoj about the testimonies of some witnesses who had admitted to the Commission that they had listed Tuaran, Sabah as their place of birth when in fact it was Pakistan, Jariah said was important that these records be corrected.

Jariah said false details in NRD records was among the problems of identity cards issued in Sabah. Others included details such as photographs, fingerprints and names being amended in the department’s files.

There were also instances of identity card holders not having any records in the NRD or the details in the identity cards were suspicious such as blurred photographs in the documents.

She also said 639 identity card numbers were shared by 1,177 people and this happened because the documents were issued manually years ago.

Asked by Manoj about the possibility of “rogue” senior NRD officer, such as a state director being able to issue Malaysian citizenship and identity cards illegally to foreigners in Sabah, Jariah said: "This cannot happen again.”

"The power in the issuance of citizenship is now centred at the NRD headquarters and all applications have to be vetted by the committee. It is unlike before when the power to approve Malaysian identity cards was in Sabah.

"Various laws have been streamlined since 1990 and procedures have been standardised as well,” she added.

Jariah, however, said that a senior Sabah NRD officer had been arrested by the police for allegedly being involved in the issuance of identity cards through dubious means.
“I do not know the extent of the officer’s involvement but police in Sabah have opened an investigation paper into the case and the officer has been suspended from work pending the investigation,” she said.

Jariah said the second phase dubbed as P2 was carried out between 1984 and 1988 involved the issuance of 62,550 and many of these were incomplete as they did not have any supporting documents.
The third phase dubbed P3 was carried out between 1990 and 1996 involved the issuance of 16,699 temporary identity card receipts which have since been revoked.
To a question from conducting officer Manoj Kurup, Jariah said only 8,887 holders of the “bunga raya” identity cards issued under the P1 and P2 phases have come forward and applied to change their documents to the MyKad.

The meeting, however, was stopped after the setting up of the Royal Commission of Inquiry which she said was also looking into the same issue.
