Yong files four suits against Junz, DAP

KOTA KINABALU: Sabah Progressive Party (SAPP) president Datuk Seri Yong Teck Lee has filed four separate libel suits against Likas assemblyman Junz Wong Jun Han and Democratic Action Party (DAP) at the High Court here and is seeking a total of RM4 million in damages.
In the first, second and third suits, Yong named Junz and DAP as first and second defendants respectively, while in the fourth suit, Junz was named the sole defendant.
Yong has named himself as first plaintiff and SAPP as second plaintiff for the first to third suits, and as sole plaintiff in the fourth suit.
According to counsels, Ken Yong Chie Man and Peter Marajin, acting for the senior SAPP leader, he is seeking RM1 million in damages for each suit.
Three of the four suits were filed on December 30, 2013 while another suit was filed on January 13, 2014 at the High Court here.
Counsel Joan Goh is representing the first and second defendants.
High Court deputy registrar Steve Ritikos fixed April 14, this year for pre-trial case management as pleadings from both parties have yet to be closed.
The first suit referred to a statement published in The Borneo Post on January 24, 2013 entitled “Sabahans are no fools – DAP” which Yong claimed that Junz had made in his capacity as a DAP Sabah Youth Publicity Secretary at that time. Yong claimed that the statement had accused him of being the ‘mastermind’ behind the migration of undocumented persons into the country for unlawful purposes.
Yong claims that the statement by Junz had carried the implication that he had won all his elections prior to 1999 with the help of illegal voters, and SAPP as a dishonest party. The statement, he said, contained grave and serious allegations, imputations and innuendoes that amounted to very serious libel against him and his party, SAPP.
In the second writ, Yong referred to the same contended statement as in the first suit but published in the newspaper, Daily Express on January 25, 2013, entitled “SAPP also relied on illegals: DAP.”
The third suit filed against Junz referred to a half-page advertisement titled “Believe DAP, Don’t Be Cheated Again” published in See Hua Daily News and Overseas Chinese Daily News on May 4, 2013. Yong claims that the statement connoted, amongst others, that he had been dishonestly inconsistent on the issue of Sabah’s illegal immigrants problem and had been covering up the alleged “Project M” that issued dubious citizenship document to illegal immigrants.
According to Ken Yong, the first three suits have been served on the second defendant’s (DAP) registered address in Kuala Lumpur.
In the fourth suit, Yong is suing in regard to a Facebook posting made in a ‘United Borneo Front (UBF)’ Facebook group page. He claims the statement on Facebook accused him of abusing his power as SAPP president and being involved in an alleged RM50 million bribery deal between SAPP and the Prime Minister of Malaysia to split votes in the General Elections 2013.
It said in all four writs, Junz had consistently shirked demands for full apologies to be issued, and retraction of the statements which Yong is suing for.
Yong is claiming embarrassment, distress and mental anguish suffered since he and SAPP were then subjected to investigations, enquiries and explanations resulting from the sensationalized news and gossip.
For all four suits, Yong and SAPP are also seeking for an injunction to restrain Junz and DAP or others from the party from further publishing the said statements or similar ones against them. Yong said the content, gravity, venom and scare mongering of the said statements by Junz and DAP has gravely damaged his reputation.

PETALING JAYA 28 FEB 2013: Bekas ahli Umno, Siti Aminah Mahmud, 63, berkata, beliau bersama kumpulannya pernah membantu pendaftaran setengah juta kad pengenalan (IC) kepada pendatang tanpa izin di Sabah untuk dijadikan pengundi BN.
Menurutnya, pendaftaran segera itu dibuat di bawah ‘projek IC Mahathir’ dari 1990 hingga 1994.
“Setiap kali dihantar berguni-guni (IC). Ia diproses dalam jangka masa sebulan. Katakan (pendaftaran) dibuat pada satu hari bulan, maka ia (IC) akan diserahkan pada tarikh yang sama pada bulan yang akan datang,” kata bekas ahli Umno Cawangan Skudai Kanan, Johor Bahru itu pada sidang media di ibu pejabat KEADILAN hari ini.
Bekas tahanan Akta Keselamatan Dalam Negeri (ISA) itu ditemani Ketua Wanita KEADILAN, Zuraida Kamaruddin; Pengarah Guaman, Latheefa Koya dan Ketua Biro Kebudayaan dan Kesenian Majlis Pimpinan Wanita KEADILAN, Dayangku Intan.

Siti Aminah berkata, pendaftaran projek IC itu bermula di pejabat Umno Sabah di Simbulan, dalam bangunan dimiliki Datu Mustafa Harun, pemimpin Usno Sabah.
Dedahnya, projek itu dibuat ‘dengan kerjasama’ Jabatan Pendaftaran Negara (JPN) Sabah yang turut mengarahkan penerima IC terbabit mengundi BN dalam pilihan raya umum.
Siti Aminah berkata, semasa bertugas sebagai Pegawai Penerangan Umno, lima peranan beliau dalam ‘projek IC Mahathir’ adalah untuk membantu kempen Umno di Sabah, menambahkan undi Melayu, mencari pemastautin Sabah yang tidak memiliki IC dan memastikan Parti Bersatu Sabah (PBS) tumbang.
“Masa mengurus untuk orang ambil IC, kita pergi ke tempat yang sudah sedia dengan satu ‘ketua’. Bila kita sampai di satu-satu kawasan, senarai nama telah siap, meliputi nama asal atau bukan asal,” katanya.
“Bila kita tengok ada nama bertentangan dengan nama orang Islam, kita ubah jadi nama Islam. Lepas itu kita ambil gambar dan cap jari dan hantar ke pejabat Umno,” jelas Siti Aminah lagi.

Esscom director general Mohammad Mentek said Kampung Mangkalinau recorded the highest number of non-citizen households at 70%.
SANDAKAN: A census by the Eastern Sabah Security Command (Esscom) at four water villages in Sandakan found they had a total of 4,928 houses with 24,931 occupants.
Director-General Mohammad Mentek said 58% of the houses or 2,847 houses were occupied by non-citizens while the remaining 42% or 2,081 were Malaysian households.
He said Kampung Mangkalinau recorded the highest number of non-citizen households at 70%.
The number of houses occupied by non-citizens was also high in the water village of Kampung Forest (including Good View) at 55% (653 houses) whereas 536 houses (45%) belonged to locals.
“However, houses occupied by locals in Kampung Muhibbah and Cahaya Baru surpassed non-citizens,” he told reporters after chairing the post-mortem on the  census  here yesterday.
Mohammad said the census went smoothly and found 244 houses were vacant.
“We are going to carry out a “Mopping-Up” exercise and will ask Statistic Department officals to return to the water villages to carry out a further census on the vacant houses,” he said.
He did not rule out the possibility of the vacant houses being occupied by illegal immigrants who fled during the census exercise.
He said no arrests were made during the census operation.
Mohammad also denied Esscom had demolished several houses in the affected water villages during the census operation.
“Not even a single house was demolished. Such an allegation is unfounded,” he said.
Mohammad said the census operation had received close cooperation from villagers and community leaders.
He said one of the main challenges of the operation was the unpredicatable weather and poor infrastructure including narrow bridges or narrow jetties.
Mohammad said a total of 171 of enumerators and 258 officials from state and federal government departments and agencies including security teams were involved in the operation.
Mohammad said the outcome of the operation will be thoroughly scrutinised prior to submission to the government for further action, including determining whether the affected villagers need to be relocated or otherwise.
Mohammad said Sandakan was one of the three districts in the Eastern Sabah Security Zone (Esszone), besides Semporna and Lahad Datu, selected for the pioneer census programme.
Esszone covers 10 districts, the other seven being Kudat, Kota Marudu, Pitas, Beluran, Kinabatangan, Kunak and Tawau. It was established following the violent intrusion by armed Sulu terrorists in Kampung Tanduo, Lahad Datu, in February last year.

Lack of proof, so Pakistani freed

Kota Kinabalu: A 40-year-old Pakistani was freed of a charge of causing the death of a 16-year-old girl in Kota Marudu two years ago. Sessions Court Judge Ishak Bakri acquitted Amir Ali Khan Nawaty without his defence being called on the charge.
Amir was alleged to have committed the offence on one Norikoh Saliwah in a moving lorry headed from Kota Marudu town to Langkon, at Km 2.8 along Jalan Kota Marudu-Langkon, between 11am and 12.30pm on Nov 25, 2012.
The offence under Section 304(b) of the Penal Code carries a jail term of up to 10 years, or with a fine or both, on conviction.
In acquitting Amir, Ishak said the prosecution had failed to prove a prima facie case against him.
Ishak, however ordered Amir to be referred to the Immigration Department immediately for further action following an application by the prosecution because Amir's passport had expired during the remand period.
Amir, who was then whisked away to the court cell, said he was satisfied with the decision and looked forward to have his passport renewed.
In delivering his ruling, Ishak, among others held that all the prosecution's three witnesses - Arwin Amin, Turagis Lamun, Nina Natasha Bigong were neither able to supply the registration number of the lorry nor were able to categorically state whether Amir was either the driver or the passenger of the lorry at the time of the incident.
"Nevertheless all three of them provided the description of the lorry, to my understanding referred to the lorry owned by the accused (Amir). Their description also matched one that was furnished earlier by Bibianah Saliwa (Norikoh's sister) regarding the lorry in which her sister, the deceased boarded.
"Turagis in particular was able to provide a highly detailed description of the lorry that he had witnessed. The features described include a white body, a black wall É and a yellow and read rear sticker at the back of the lorry.
"Furthermore, in his testimony, Turagis had also stated that he could see two persons in the lorry before the girl swung open through a window at the back of the cabin.
"This description appears to be consistent with the lorry and the photograph he identified.
Furthermore, Turagis, Arwin and Nina identified the said lorry from the photograph shown to them in court.
"To further strengthen this, Turagis has been able to identify the particular lorry among the lorries parked at the police station at that time. Therefore, the combined testimony of these three witnesses alone had in my mind been sufficient to establish a prima facie case for the allegation that the deceased had indeed fallen from the lorry belonging to Amir, which was the one identified by these witnesses.
"However, the odd decision subsequently made by the prosecution to call on Mohd Ibrar (a Pakistani) to identify the said lorry, even when a prima facie case could have already been established by the prior three witnesses served to compromise my conviction," said Ishak.
He said the last eyewitness offered by the prosecution - Mohd Ibrar testified that Norikoh died as a result of falling from a different lorry.
"According to Ibrar, although he was nearly 10 metres away from the lorry as he witnessed the deceased falling from the lorry onto the ground, in his recollection, the lorry was not the same as the one shown in the photograph, which had been identified by the prior three witnesses.
"Ibrar maintained his assertion that it was not the same lorry throughout the examination-in-chief and cross-examination, attesting that the lorry that he witnessed was old, had an old black rear door and no yellow and red rear sticker at the back," said Ishak, adding that it clearly contradicted the testimony of the previous three witnesses.
Ishak also held that he did not have the opportunity to observe the demeanour of Mohd Ibrar, whether he appeared to be telling the truth based on his overall demeanour.
"From the notes of the proceeding, there was nothing to show that this prosecution witness was impeached on his testimony nor was he treated as hostile witness nor was he challenged by the prosecution that he is lying or not telling the truth.
"Furthermore, neither DNA nor finger print matching those of the deceased was found on the lorry belonging to the accused that could conclusively prove that the deceased had been in the said lorry on that day.
"Had the Deputy Public Prosecutor sought to dismiss the testimony of her own witness, Mohd Ibrar or successfully impeached his contradictory testimony, then my decision should have been very different," said Ishak in acquitting and discharging Amir from the charge without calling him to enter his defence.
Ishak had earlier held that it must be noted that he did not have the opportunity by himself to see and to hear the prosecution's witnesses and that his ruling was based on his reading and examination of testimony of witnesses, note of proceedings as well as the submission by both the prosecution and the defence.
The prosecution had called 40 witnesses to testify before the previous judge Duncan Sikodol, who is now with the Attorney General's Chamber in Putrajaya.
Meanwhile, DPP Raja Zaizul Faridah Raja Zaharuddin said the prosecution would be filing an appeal to the High Court against the decision.
Counsel Peter Marajin, who is holding a watching brief for the girl's family, said the prosecution's decision to appeal was a very good one for the sake of justice.
Amir was represented by counsel Dato Rakhbir Singh.
