Letter to the Editors – Let the guilty ones come forward to be witnesses.

According to Wikipedia –“Royal Commissions usually involve research into an issue, consultations with experts both within and outside of government and public consultations as well. The Warrant may grant immense investigatory powers, including summoning witnesses under oath, offering of indemnities, seizing of documents and other evidence (sometimes including those normally protected, such as classified information), holding hearings in camera if necessary and—in a few cases—compelling all government officials to aid in the execution of the Commission.
A Royal Commissioner has considerable powers, generally greater even than those of a judge but restricted to the Terms of Reference of the Commission.”

I had wanted to set up a watchdog group known as Royal Commission of Inquiry Coalition or RCIC and yet little response from the public just prior to the sitting of the Royal Commission of Inquiry on Illegal Immigrants of Sabah [RCIIIS] in January, 2013.  RCIC could be the united Voice like what S. Karim wrote in Daily Express of 25th August, 2013 titled “How will panel know lies from facts?” where some allegations could be unfounded.

I also do not know if my comments here can be subjudice as the RCIIIS can be more powerful than a Judge and the RCI is further empowered by an act of Parliament with wide powers especially those who fail to attend on a subpoena.

Reading some of the strong statements by S. Karim, I would like to hear from the RCIIIS what action would be taken by the RCI on those statements.

I think RCIIIS knows what to do for the Inquiry and we should leave it to them to do so accordingly with whatever materials published or unpublished as sources of references.

What I hope now is that I would be called to be a volunteer witness after giving my Statement to them in November, 2012 and submitting an Affidavit of 31 pages assisting the RCIIIS in whatever possible as the author of  EPIC OF SABAH in three editions with the first edition done in July, 2002. 

I also hope that RCIIIS would call more of the key figures as witnesses who had been implicated in the commission of the Project IC for more than three decades resulting in 1 to 2 millions of such holders in Sabah and beyond.  This RCI should be expanded to the whole nation.

Finally, what is more important is that a comprehensive Reports would be published as soon as possible and that the authorities would implement those measures including charging those who mislead the RCIIIS and those who were parties to the commission of Project IC.  We need clear and effective solutions and not hindrances to execute the Report of the RCIIIS to solve the crisis of the exploding and explosive population of Sabah and beyond once and for all albeit belatedly for decades.

Police Nab 24 Illegal Immigrants In Lahad Datu

LAHAD DATU, Aug 19 (Bernama) -- Police arrested 24 illegal immigrants after making four separate raids at two locations in Lahad Datu early yesterday morning.

Lahad Datu police chief Supt Shamsuddin Mat said the men, aged between 20 and 50 years, were among the 62 individuals, including a woman, who were inspected in the eight-hour integrated anti-crime operation.


"They were arrested for failing to produce valid identification documents when requested to do so," he told reporters here today.


He said the operation, which began at 4am and went on till noon, involved 79 members of the Royal Malaysian Police, the Department of Immigration, National Registration Department, Lahad Datu District Council, the Civil Defence Department and RELA.


A 34-year-old man on the streets of Kg Panji was also arrested at about 10.30am on suspicion of drug possession.


Shamsuddin said police, with the cooperation of the various agencies will intensify the integrated operations from time to time.


The public are also requested to contact the nearest police station or call the operations room at 089-881255 to report the presence of illegal immigrants in their respective areas, he said.

An integrated operation against illegal immigrants in Sabah will be carried out soon, Chief Minister Musa Aman said today.

He said the operation would focus on areas in the east coast of the state before expanding it to other areas.

It would be coordinated by the Federal Special Task Force (for Sabah and Labuan)and involve the relevant departments and agencies, including the police and the army, Immigration Department, Malaysian Maritime Enforcement Agency (MMEA), the People's Voluntary Corps (Rela), National Registration Department and the Civil Defence Department, he added.

He was responding to a question by Joniston Bangkuai (BN-Kiulu) during the question-and-session at the Sabah state assembly sitting in Kota Kinabalu today.

Besides the integrated operation, Musa said the Immigration Department would also carry out a state-wide operation by focusing on the manufacturing and plantation sectors.

“The purpose of the operation is to ensure employers and workers in both sectors abide by regulations,” he added.

He also said that the Eastern Sabah Security Command (Esscom), together with agencies like the Malaysian Statistics Department, the police, district offices and the Chief Minister’s Department, had conducted a census on residents in several of the floating villages.

The census was done to determine the background of the residents and also to facilitate the government in planning of their resettlement and for village restructuring programme.

Musa said that between January and July this year, the Immigration Department hand conducted 252 operations and checked 4,350 people, where 2,022 of them were detained for further investigation.

Fourteen employers were also arrested for breaching provisions in the Immigration Act, he added.

He said a total of 5,130 illegal immigrants were detained for investigation by enforcement agencies in the state between January and July this year.

8,910 illegals immigrants deported

During the same period, a total of 8,910 illegal immigrants had been deported to their respective country of origin through the port of Sandakan, Tawau and Semporna, he added.

He said Filipinos topped the list of illegal immigrants who were deported, at 6,209 people, followed by Indonesians (1,870), China nationals (38), Vietnamese (30), Pakistani (24), Nepalese (12), Indian (three), Ukrainian (two), and one each from Germany and Brunei.

As of Aug 13, he said there were still 2,751 illegal immigrants at the temporary detention centres in Papar, Sibuga and Tawau, where 2,358 were from the Philippines and 351 Indonesians.

The illegal immigrants still at the detention centres will be deported after  their travel documents are issued by their respective embassies, he added.

Musa said patrolling of the state territorial waters, covering Kudat, Kota Marudu, Pitas, Beluran, Sandakan, Kinabatangan, Lahad Datu, Kunak, Semporna and Tawau, as well as the islands, had been stepped up with the setting up of Esscom.

70,000 late registration cases in Sabah – NRD

SANDAKAN: The National Registration Department (NRD) has successfully registered some 70,000 cases for late registration of births and identification cards through its Special Mobile Unit (SMU) throughout the state since 2000.
State NRD director, Ismail Ahmad said the late registration involved local people in the remote rural areas and those people with special needs, elderly and orphans.
“SMU is one of the initiatives mooted by NRD since 2000 to help locals with late registration for birth certificates and identity cards. The target also includes special cases such as victims of fire and other disasters.
“With this facility, the registration process becomes easier and faster due to the availability of Internet access which allows details of applicants to be sent directly to the  headquarters. Previously, the information collected would be brought to the office for follow-up,” he said to reporters during the registration for replacement of documents for fire victims of Kampung Cenderamata, Batu Sapi at the school hall of SK Karamunting, yesterday.
A total 509 residents were registered, he added.
Ismail said the SMU was now equipped with Internet access via its satellite dish since last month and enables the registration of documents to be completed immediately.
The unit is to focus on the late registration documents for the locals living in the rural areas or remote areas in the the state that mostly faced logistic problems.
In another development, he said four NRD Offices, namely Keningau, Sandakan, Tawau and Lahad Datu were expected to receive printing machine in January 2014 to allow processing of identification cards in a day.
For the record, only the NRD Office in Kota Kinabalu has the printing machine.

Kota Kinabalu: Former Chief Minister Tan Sri Harris Mohd Salleh said Saturday he is ready to rebut any allegations made against him in the ongoing Royal Commission of Inquiry (RCI) on Illegal Immigrants in Sabah, "but that there is nothing to rebut if they are wild statements".
Instead, he said, some of those who testified should be charged with perjury or for lying under oath. He said he had officially sent a written a response to the Commission Chairman Tan Sri Steve Shim and members of the Commission via Poslaju.
According to him, much of what transpired in the hearings were not corroborated nor were the witnesses subjected to any cross-examination.
Referring to the claims about him (Harris) made by Hassanar Ebrahim, a former ISA detainee, when testifying before the RCI on Friday, he said there was no question of him declining to take the stand to rebut the claims, as reported. "That was far from the truth."
In fact, Harris said, he was at the courthouse from 8.30am that day as he was summoned to be there until about 12pm. He said he was asked to be at the waiting room, adding his summons was from Aug. 15 to Aug. 16. However, later he was told to come at 8.30am on Aug. 16 whereas the sitting only started at 9.30am.
He said about 11.30am, RCI conducting officer Manoj Kurup came into the waiting room and there was an officer by the name of Kuhairi from the Commission talking with him.
Harris said Kurup told him he was free to decide whether to rebut or not and then briefed him in front of the officer and asked for the door to be closed.
He said Kurup repeated what Hassanar had said in his testimony and briefly as follows:
"You (Harris) arrange a meeting of leaders at his house and brief what transpired between you and Tun Mahathir. He said you asked him and Datuk Yahya Lampong to go to see Tan Sri Megat Junid.'
"Hassanar also claimed he was given 31,000 copies of the application forms by Tan Sri Megat Junid. Hassanar also claimed that you told him there were already 138,000 identity cards issued.'
In response, Harris said he then asked Kurup whether Hassanar was asked to prove his general statements and that Kurup did not answer.
He also asked Kurup whether the President of Tawau Municipal Council, Ismail Mayakob, could prove the claim that more than 40 per cent of Tawau's population now comprised foreigners.
"I wanted to know if the Commission asked Ismail whether he
i) had conducted a survey?
ii) regarded that those people given ICs over the years are foreigners?
iii) Who was the Malay population of Tawau 100 years ago?"
He said after Kurup briefed him, he (Kurup) once again asked him whether he wanted to rebut Hassanar's statement and he responded saying there was nothing to respond to such general statements.
"What Hassanar said was untrue. Just take the 31,000 application forms claimed by Hassanar that Megat Junid gave him. The Commission should ask Hassanar
i) Did you collect the forms from Megad Junid's house or his office;
ii) How many kilos were the forms - 100 to 200kg?
iii) Who paid for the air freight?
iv) Do you agree you were only given few hundred copies of the form at that time?" said Harris.
Harris again maintained there was no "Project IC" and, if any, all was done through the normal channel.
"Therefore the statement by Mat Swardi Awi that he masterminded the Project IC was also not true.
"Tun Mahathir did not need a Master Mind to carry out and implement a Federal Government Policy to give Identity Cards as the Federal Government deems fit," said Harris.
He said Dr Mahathir, by invoking Federal Government policy to grant citizenships to those foreigners and refugees had all the Federal Government machinery behind him.
"Common sense dictates that Dr Mahathir did not need an ex-banker who was at that point of time in the wilderness looking for opportunity. Therefore, Mat Swadi's claims were complete lies.
"All ICs were processed and issued by the Registration Department.
Papers are completed to whatever the department's requirements," said Harris.
Harris further said he noticed in the papers "many statements made to the Commission which were false".
"The Commission must investigate these thoroughly and if found not true they should be charged for perjury as in other countries.
"Hassanar was the first witness. What he said to the Commission, especially all his statements, were not in my presence.
These statements were not substantiated by facts or corroboration, so it is not expected to be rebutted by anyone," said Harris.
Similarly, he said, to the claim made by Mat Swadi Awi that he masterminded the project IC.
"If this statement were taken as a fact by the Commission then this would exonerate the claim that Tun Mahathir or Harris or others were masterminds or main movers of the IC project," said Harris.
Harris said he is ever willing to testify before the Commission again and it can call him at anytime and any day.
However, he will only rebut those statements.

He added that just in the Libaran parliamentary constituency alone, where the Sungai Sibuga state seat held by Chief Minister Datuk Seri Musa Aman is located, there were more than 10,000 ‘illegal voters’ or non-Malaysian who were given ICs to make them eligible to vote.
The Commission was also informed that reports on the matter has been lodged with the police, Immigration Department as well as the NRD but thus far no action has been taken.

KOTA KINABALU: Former Internal Security Act (ISA) detainee Hassnar Ebrahim told the Royal Commission of Inquiry (RCI) on illegal immigrants that the issuance of identity cards to immigrants in Sabah was needed to help increase the political power of the Muslim Bumiputeras to put a stop to the discrimination against them by Parti Bersatu Sabah (PBS).
Hassnar said he willingly took part in the exercise, knowing fully well it was against the law, not for his own personal interest but with the intention of returning the political status quo and stability to all Sabahans.
“By status quo, I mean the pre-PBS era.. The intention was to make sure that we can all live in harmony again and not having to fight each other. Don’t get me wrong, I don’t mean that I didn’t want the KDM to have political power.
“I’m talking about the discrimination practised by the PBS government. We never use to have any issue of power sharing, distribution of wealth as everyone can sit together as family. But when PBS came to power all that changed,” he said when testifying before the RCI yesterday.
Hassnar said the party, among others, marginalized the Muslim Bumiputeras in the distribution of native lands. He claimed lands were only given to KDMs and even to non-natives to buy their political loyalty, while the Muslim natives were being sidelined. He said the PBS action has caused racial polarization that remains until today.
“My mother is a Dusun but she would not support me because the way she thinks is that Dusun is for Dusun. Such was the way of thinking that the Dusuns were with the Dusuns, the Kadazans with the Kadazans, the Bajaus with the Bajaus and so on.
“I believed it was for something noble, for my religion, my people and for Sabah. In such desperate situation, you would not pay as much attention to the law. It was something that needed to be done, I was thinking that even if I go to jail because of it, so be it,” he said.
Hassnar said the effect of the discriminatory practices could still be felt today, including in the issuance of Native Certificates (NC) where non-native individuals continue to use the document to rob the locals of their rights.
Commissioner Herman Luping, who is a former PBS leader, interjected that it was never the intention of the PBS state government to issue NC to non-natives and allow them to own native land.
He clarified that it was the result of corruption among the Native Court officers when issuing the document.
Asked what caused him to expose the exercise in the end, Hassnar said, he came to a realization that the whole thing was being abused by certain quarters to promote their own agendas instead of ensuring equal rights for the people.
He said, it was after he was arrested that it became obvious to him that the whole project no longer had the same objective as it was in the beginning, but has now become a tool for certain quarters in Kuala Lumpur bent on dominating Sabah.
“The situation is now different, ensuring political power for the Muslim Bumiputeras has become a second thing. Now it is only about certain parties wanting to maintain power at all costs.
“As a result, Malaysianized immigrants have overrun the native communities. They dominate the hospitals, education. They also diminished the rights of the Bumiputera in economy as well as over their lands,” he said.
Hassnar reinforced his claim that the issuance of ICs to immigrants is still ongoing until today, citing an Indonesian being given a MyKad in 2008 using a genuine birth certificate belonging to a local, who have died and whose death was not reported to the National Registration Department. Documents supporting his claim, including photocopies of the IC of the said Indonesian and the birth certificates of his five children were submitted to the Commission as evidence.
He also claimed that phantom voters or individuals who are not the actual persons that should be voting, can be found in every elections held in Sabah.

Hassnar, who admitted to have been involved in the exercise, better known as ‘Project IC’, when he was the Sandakan district officer in 1981, has suggested that the Malaysian Anti-Corruption Agency (MACC) is further strengthened and empowered to curb Project IC. He said the agency should, for a start, be given more manpower so that it could investigate the continuous unlawful issuance of IC.
He also expressed his support for the recommendation to have every IC application reviewed by a State panel before it can be approved by the NRD, and to get the court to stop issuing verification for late birth certificates and statutory declarations.
On the proposal to recall back all ICs issued in Sabah, he said, it was a good suggestion but could have major social and economical implications on the State.

SABAH RCI The National Civics Bureau (Biro Tata Negara or BTN) was responsible for registering illegal immigrants as voters after being granted blue identity cards, the royal commission of inquiry (RCI) on immigrants heard today.
Former Sandakan district chief Hassnar Ibrahim ( left ), a key witness during the successful 1999 Likas election petition, implicated the controversial agency when testifying before the RCI at the Kota Kinabalu Court Complex this morning.
"That question should be directed to the BTN in the Prime Minister's Department. They were responsible," Hassnar said when asked who were behind the registration of illegal immigrants as voters after securing blue identity cards.
Earlier, Hassnar explained the modus operandi of the illegal granting of blue identity cards to Muslim foreigners, dubbed 'Project IC', was divided into two phases, one before 1985 and the other after 1985 when Berjaya lost the state government.
"Before 1985, it was to maintain the status quo where Sabah was ruled largely by Muslims.
"After 1985 when Berjaya lost, it became more political and the purpose was to oust PBS which had discriminated against Muslims," he said.
Hassnar, who was Sandakan district chief from 1983 to 1985, said that Project IC had began as early as 1972 as an "opportunity" arose when war broke out in the Philippines and there were readily available Muslim refugees flooding into Sabah.
"When I entered office (as district chief), I was asked to sign a ream of 500 blank HNR10 forms which also bore the signature of district officer Hassan Alban Sandukong (later deputy Sabah speaker).
"There were no specific instructions from anyone and I just signed them because this had been the past practice," he said.
HNR10 forms are similar to a statutory declaration and with the verification of a district officer and district chief or native chief, can be used as a valid document to prove that one was local-born Sabahan.
He said the new identities of illegal immigrants are then filled in these forms and used as evidence that they were 'locals'.
These people will also fill in the HNR3 form, the application form for blue identity cards, which is facilitated by another team tasked with going around finding suitable candidates.
"The HNR3 and HNR10 forms were later brought together and filled into the HNR1 form (Kertas Biru), then sent to National Registration Department (NRD) which was then in Petaling Jaya.
"There, they will laminate the HNR1 which becomes a complete identity card and is sent back to Sabah for distribution," he said.
Hassnar said there were 23 districts in Sabah with each having between one to three district chiefs such as himself and five to six native chiefs who would have to endorse the forms.
He claimed that up to 1985, a total of 138,000 blue identity cards had been given to foreigners through this method.
He added that then-home minister Ghazalie Shafie had allowed the HNR forms to be taken out of NRD and distributed.
'Phase 2'
However, Hassnar said when Berjaya was ousted by PBS in 1985, his role in Project IC went beyond the routines of a district chief.
"I was invited to meet former chief minister Harris Salleh. He said he had met (then-prime minister) Dr Mahathir Mohamad and they agreed that the process of increasing Muslim voters had to be identified.
"I was instructed to meet (then-deputy home minister) Megat Junid Megat Ayub in Kuala Lumpur.
"When I met Megat Junid, he said this had been approved by Mahathir and asked me to prepare a working paper to increase the voters in all 48 constituencies in Sabah," he said.
Hassnar said after preparing the working paper, he attended a meeting in Kuala Lumpur chaired by Megat Junid ( left ), consisting of top officials from the police, NRD, Immigration Department and M6 unit from the Prime Minister's Department.
"The then Sabah NRD director Tuan Haji Sani Abdullah refused to join the meeting. He said this was treason and it would cause a disaster," he said.
Hassnar said the plan, which proposed the addition of 130,000 to 150,000 voters, was eventually approved despite protests from another officer, from the M6 unit, who was in the meeting.
"I was then given 30,000 HNR3 forms to take back to Sabah and a meeting was convened in Harris' office meeting room with several leaders to distribute the forms," he said.
However, Hassnar added, half-way through, he was called back to Kuala Lumpur by Megat Junid.
"Megat Junid said (then Sabah chief minister) Joseph Pairin Kitingan had met with Mahathir and asked that I be arrested. So he told me to lie low for the moment.
"I reported this back to Harris but Harris called Megat Junid a stupid minister and he said if we are arrested, so be it," he said.
Hassnar said this made him torn between Harris and Megat Junid, for he was now not sure whose orders to follow.
Arrested and held under the ISA
"After I collected part of the HNR1, HNR3 and HNR10 forms, I flew to KL to meet Megat Junid, but I could not meet him.
"I was arrested at Subang airport, together with the documents," he said.
Hassnar was detained under the Internal Security Act in 1988 for 60 days before being placed under restricted residence until 1990.
He said he had engaged in Project IC because he thought that maintaining the Muslim leadership then was a noble cause.
"But it got out of hand and now these foreigners are even taking over native lands that belong to the original bumiputera Sabahans," he said.
Later, conducting officer Jamil Aripin ( left ) pointed out that Hassnar's testimony today was different from his statement given while he was held under the ISA.
To this, Hassnar replied: "When I was freed... the police said they have two files on me, one was on whatever I have said, and another is a story that I will find out in future.
"That is why I don't trust the police. Whatever I have said in the newspapers is the real version," he said.
Asked by Jamil whether the police had provided the RCI with a false version of his statement given when he was held under the ISA, Hassnar concurred, adding: "The police lied."

KOTA KINABALU: Parti Bersatu Sabah (PBS) president Tan Sri Joseph Pairin Kitingan said the first step in resolving Sabah’s problem with the influx of immigrants was to stem the flow of people entering the state illegally.
“The next step is to look at those who are already in Sabah and what to do with them. Those with jobs should be regularised and documented while those without documents should be sent home to their respective home countries,” he said.
Pairin who is the 199th witness to give evidence at the Royal Commission of Inquiry on the presence of illegal immigrants in Sabah said this when asked by conducting officer Manoj Kurup on what he thought should be done to resolve the problem in the state.
The Deputy Chief Minister also said another solution would be to recall identity cards issued to those by way of statutory declaration because they were likely to have been issued to those who were not qualified in the first place.
“There are so many of these Statutory Declarations that this is no joke. By vetting through the Statutory Declaration we can determine if they are genuine,” he said.
Pairin also told the panel that when he was the Assistant Minister to the Chief Minister during the Berjaya era, he had spoken out about the need for the federal government to resolve the illegal immigrants problem in Sabah but was in return reprimanded for it by the top Berjaya leadership.
“It wasn’t really made clear but what was said was that I should not talk about this issue anymore. I kept that in mind but on occasion I would touch on that matter and the reaction was the same. I was not a happy man (at that time) because the top government was not happy with me,” he stressed.
According to him, the people in Sabah at that time were generally not happy because laws on entering Sabah were not enforced because nobody should come into a country without any documents.
“We continued to harp on this issue and I remember the government took some steps to clear squatter colonies in and around Kota Kinabalu but that was not the final solution … it continued to be a problem.
“PBS when in government continued to harp on this and took pains to conduct investigations into the issue and I personally presented the findings to the then Prime Minister. I believe the result of this was the setting up of the Federal Special Task Force,” he said.
Pairin also told the panel that he had requested the federal government to take the necessary steps to resolve the issue and assured it that the state government would assist as much as possible within its power.
“As PBS was in the opposition then, the federal government decided that I was qualified to sit as the chairman of the State Security Council which went against the grain of resolving the problem,” he stressed.
According to Pairin, the PBS government implemented an amnesty program for illegal immigrants in the state and through it, registered about 60,000 people.
“After that, indications came from the federal government to stop the program,” he said, and when asked if he knew the reason why, Pairin replied: “That is a very debatable area. There were so many things going on that did not please the federal government. Obviously we continued to harp on the issue and when incidents like the kidnapping (in Semporna) happened, the authorities took steps like increasing the manpower of the security forces there but that was not enough.
“PBS as a party tried to take the matter up with the government and called for the setting up of a Royal Commission of Inquiry to look into the influx of immigrants into Sabah. We were not the only party concerned as other political parties were equally concerned with the need to see that the problem was addressed,” he said.
Then other events took place that were against the law of the country like the syndicates issuing ICs through dubious means and names of foreigners who were not Malaysian citizens appearing in the electoral roll.
He disclosed that PBS’ studies then showed that there were about 80,000 names of phantom voters found in the electoral roll.
“It became a political issue and we expected the Election Commission to remove the names from the electoral roll because they were not genuine Malaysians. A lot of the names were removed and we were happy but at the next general election, some of the names were still there,” he said.
“In the context of false ICs or phantom voters, we could see foreigners holding two identification documents bearing different names but the same photograph. This indicated that the person could vote twice,” he said adding that he had raised the issue up in parliament.
Pairin claimed that lack of enforcement of the nation’s laws was among the reasons why the illegal immigrant problem in Sabah could not be solved as people could just enter or leave the state without any hindrance.
“By right, those in charge should not be thinking twice about safeguarding our nation’s security and sovereignty,” Pairin added.
Asked by commission chairman Tan Sri Steve Shim if there was a lack of political will to resolve Sabah’s immigrant problem, Pairin said: “I agree with that. There must be political will to enforce the laws big or small. It should be important that we do not even think twice about enforcing our laws.”
Pairin also said PBS, along with other BN component parties, had agreed that there was a need to bring up the issues of setting up the RCI to Prime Minister Datuk Seri Najib Tun Razak which the latter did after “a lot of convincing” Pairin added.
“To me, this is a very strong proactive action on his (Najib’s) part as it shows that he acknowledges the problems presented to him … issues that cannot be set aside and to take the bull by the horns.”
He also said the establishment of Eastern Sabah Security Zone (ESSCOM) and ESSZONE was something that should have been done a long time ago.
“The Lahad Datu intrusion triggered the necessary steps which we have been waiting for all this while,” he said adding that the government of the day has the political will to implement the RCI’s recommendations on how to resolve the issue.
To the question by Sabah Law Association (SLA) if the PBS government could have done more to stop the influx of the illegal immigrants, Pairin replied: “I wish I could have done more. Now we have to reflect back on what were the obstacles we faced. When we pressed on the importance of tackling the issue, no action was taken.
“All the jurisdiction was under federal control and we had no direct control in that sense. We only had 11 months to govern in 1986 and we were disturbed all the time. It was such that nothing much could be done,” he said.
To Shim’s question of if there was real and effective collaboration from both state and federal governments to resolve the issue, Pairin’s reply was “Yes”.

Sabah RCI: 'Mustapha responsible for altering Sabah's demography' 

 Former Sabah chief minister Mustapha Harun was the man who started the idea of altering Sabah’s electoral demography in a bid to topple the PBS-led state government, the royal commission of inquiry (RCI) on immigrants heard today.

Mat Swadi Awi testified at the Kota Kinabalu Court Complex this afternoon that the late Mustapha had tasked him with distributing new voters in constituencies where Usno was weak to strengthen the party.

“My job was to increase the number of Muslim votes in constituencies where Usno was weak.

“Not all of them were immigrants, some were voters from the military, police or teachers from peninsula Malaysia,” said Swadi who was then working at Bank Pembangunan Malaysia Berhad in Sabah.

Usno had ruled Sabah from 1967 until 1975 before being ousted by breakaway party Berjaya, which was in power until 1985.

However, PBS, perceived to be a non-Muslim-majority party, came to power in 1985, to the chagrin of both Berjaya and Usno.

“Mustapha complained that Berjaya and Usno were divided (among Muslim voters), so to increase the vote for Usno is to ‘nationalise’ these immigrants,” said Swadi.

Swadi said in 1987, Mustapha told him of his plans and had conveyed this to then-home minister Megat Junid Megat Ayub (left), who then received approval from then-prime minister Mahathir Mohamad.

However, Swadi conceded that this was only Mustapha’s words and he had no proof that Megat Junid had actually received approval from Mahathir.


Throughout the operation until 1990, Swadi said he was in contact with Mustapha and Megat Junid.


Swadi explained that he was based in a hotel in Kuala Lumpur where he received some 20,000 photocopies of blue identity cards.


“I keyed this information into a database and analysed in which constituencies they should be distributed.


“After that, I would hand over this information to the Election Commission (EC) (for them to register as voters in said constituencies),” he said.


Pressed by conducting officer Jamil Aripin if he had proof that some of the blue identity cards were indeed of illegal immigrants, Swadi insisted that he could recognise them by the identity card number.


However, Swadi said he withdrew from the project when he found out that it had escalated to issuing the same identity card numbers to different people.


‘EC asking questions’


“One day I was called up by the then-EC secretary Abdul Rashid (Abdul Rahman), he showed me one identity card number (on the computer) and when he clicked it there were 20 names that came out.


“He clicked another and there were 10 names... he asked me to explain which one is the genuine one.


“I was taken by surprise, I couldn’t answer, it was in a mess and I said if this is the case I will stop it,” he said.


Swadi later informed Mustapha that he wanted out and left the project in 1990.


The banker had earlier claimed himself to be the person behind the “grand-design” of ‘Project IC’.

However, Jamil corrected Swadi, stating that Project IC specifically refers to the illegal granting of blue identity card to foreigners.

Swadi then concurred that he was not involved in the granting of blue identity card but merely on the distribution of new voters to selective constituencies for Usno.

Usno later merged with Berjaya in 1990 to form modern-day Sabah Umno, before wresting power from a weakened PBS in 1994 through defections.

Sabah RCI: 'I arranged meet between Sulu sultanate and two PMs'

Self-proclaimed Sabah sultan Mohd Akjan Ali Muhammad today claimed he had set up meetings between two former Malaysian prime ministers and the Sulu sultanate.

Testifying before the royal commission of inquiry (RCI) on immigrants in Sabah, Akjan said the two former prime ministers were Dr Mahathir Mohamad and Abdullah Ahmad Badawi, who is also known as Pak Lah.

“Since the 1970s (self-proclaimed Sulu sultan) Jamalul Kiram sought my help. I helped him to meet Mahathir in the 1980s but I did not know what they discussed.

“After that, Ismail Kiram (Jamalul’s brother) came to meet Pak Lah,” he told the RCI at the Kota Kinabalu Court Complex this morning.

Akjan said he had agreed to set up the meeting on condition that they would relinquish their claim on Sabah.

“But by the 2000s, their objective appeared to have changed and they wanted to claim Sabah at the International Court of Justice,” he said.

Jamalul (right) later ordered an incursion into Sabah in February this year, leading to the deaths of nine members of the Malaysian security forces, the worst losses since the Communist insurgency.

Sabah RCI: 'Suluk intruders would have backed off if I were sultan'

Self-proclaimed Sabah sultan Mohd Akjan Ali Muhammad said the Suluk intruders would have backed off from their claim on Sabah had he been made sultan of the state.

Akjan (left) told the royal commission of inquiry (RCI) on immigrants in Sabah that the intruders’ general Agbimuddin Kiram from the defunct Sulu sultanate had met him prior to their incursion on Sabah.

“When Datu Agbi came - in February if I am not mistaken - he had appealed to me to become the sultan of Sabah.

“I made an agreement with them that they would drop their claim on Sabah if I became sultan,” he testified at the Kota Kinabalu Court Complex.

Akjan said he had then conveyed this agreement to the police but they had ignored him.

“To save Sabah, I was prepared to become its sultan but the police officer I told about this did not inform his higher-ups,” he said.

Kota Kinabalu: The assertion by Datu Akjan Ali Mohammad that Suluks are "first class natives" is a gross manipulation of definition and highly mischievous, misleading and misconceived, said State Reform Party (Star) Chief, Datuk Dr Jeffrey Kitingan.
He said this is because nowhere is this stated in the Interpretation (Definition of Native) Ordinance (Sabah Cap. 64),
Dr Jeffrey said Akjan was again in one of his inventive modes, creating all sorts of lies to confuse Sabahans.
"As I have been inundated with many telephone calls from my constituents who are very unhappy with Akjan's reference to Suluks as first class natives of Sabah, I have to make a defence for true Sabahan natives," he said.
According to him, Section 2 (1) (a) of the ordinance states that any person both of whose parents are or were members of a people indigenous to Sabah could be considered as original, pure.
"Or first natives because there was no need for them to make an application to the Native Court for the Native Certificate or Sijil Anak Negeri," he said.
"Now the exact text of Section 2 (1) © quoted by Akjan states that 'any person who is ordinarily resident in Sabah, is a member of the Suluk, Kagayan, Simonol, Sibutu or Ubian people or of a people indigenous to the State of Sarawak or State of Brunei, has lived as and been a member of a native community for a continuous period of three years preceding the date of his claim to be native, has borne a good character throughout that period and whose stay in Sabah is not limited under any of the provisions of the Immigration Act.'
"The person described here must, therefore, fulfill the requirement of:
"(1) ordinarily resident (not transient); (2) has lived as member of a native community for continuous period of three years, and; (3) of good character and not illegal (in compliance with Immigration law)."
Dr Jeffrey stressed that a further requirement is that such person can only claim to be a native upon being declared by the Native Court as provided under Section 2(3) which states that:
"No claim by any person to be a native by virtue of the provisions of paragraph (b), (c) and (d) of subsection (1) shall be recognised as valid unless supported by an appropriate declaration made by a Native Court under Section 3."
"With due respect, all those claiming to be natives under section 2(1) (b), (c) and (d) of the Interpretation (Definition of Native) Ordinance must apply to the Native Court who shall make the requisite declaration with the issuance of the Native Certificate.
"Let me emphasise for those in categories (b), (c) and (d) above only when they have in their possession the Native Certificates will they have the legal standing to call themselves natives.
"As such Akjan is wrong in making a blanket definition that all Suluks are natives, let alone first class natives.
Under the meaning of true natives or indigenous people, Suluks are definitely not within the list of Sabah's indigenous peoples, or original peoples."

Four KK immigration officers charged with trafficking Filipinos

Kota Kinabalu: Four local Immigration officers were separately charged in the Sessions Court here Tuesday with several counts of trafficking 15 Filipinos and also faced alternative charges of producing fraudulent travel documents.
Abdullah Abdul Hamid, 42, Joelygen Saran, 27, Suparno Yahmin, 33, and Dennis Douglas Dunatus, 31, were brought before Judge Azreena Aziz to face the charges against them.
Abdullah claimed trial to six counts of trafficking six Filipinos between 7am and 3pm on Dec 3, 4 and 5, 2012 at the Kota Kinabalu International Airport (KKIA) Terminal 1, here.
He also claimed trial to six alternative charges of producing fraudulent passports under the Filipinos' names for the purpose of facilitating immigrant trafficking at the same place and time.
Joelygen is facing five charges of trafficking five Filipinos between 7.19am and 10.01pm on Nov 8, 27 and 28, 2012 at the KKIA Terminal 1. He denied all the charges.
He also denied five alternative charges of producing fraudulent passports under the Filipinos' names for the purpose of facilitating immigrant trafficking at the same place and time.
Suparno pleaded not guilty to two counts of trafficking two Filipinos between 7am and 6pm on Nov 27, 2012 at the KKIA Terminal 2 and also claimed trial to two alternative charges of producing fraudulent passports under the Filipinos' names for the purpose of facilitating immigrants trafficking at the same place and time.
Dennis also faces two counts of trafficking two Filipinos between 7.53am and 10.02pm on Nov 8 and Dec 1, 2012 at the KKIA Terminal 1 and he claimed trial.
He also denied two similar alternative charges as Suparno with the crimes allegedly taking place at same time and place.
The main charges against the four, framed under Section 26A of the Anti-Trafficking In Persons Act 2007, provides for a jail term of 15 years or fine, or both, on conviction.
Meanwhile, the alternative charges against the four fall under Section 26E of the Anti-Trafficking In Persons Act 2007, which carries a jail term of between seven years and 15 years or fine of between RM50,000 and RM500,000, or both, if found guilty.
Azreena set Aug 30 for case management for all cases and released them on a bail RM15,000 with RM6,000 deposited for Abdullah, RM5,000 for Joelgen and RM3,000 each for Suparno and Dennis.
She also fixed Sept 9-13 to take evidence from the 15 Filipinos following an application from Deputy Public Prosecutor Raja Zaizul Farida Raja Zaharuddin who told the court that their Putrajaya head office instructed her to apply for an earlier date to take evidence from the Filipinos.
Zaizul said the Philippine Embassy wanted all the Filipinos who were detained since last year to be deported to Philippines.
She also requested a Tagalog interpreter during the process of recording evidence from the 15 Filipinos.
Abdullah and Joelgen were represented by counsel Ram Singh and Y. S Lo and Rakhbir Singh and Hairul Vyron Othman represented Dennis and Suparno, respectively.
The four are still attached to the Immigration Department here.

Johor: "The situation here is very dangerous, gun fights often take place," said Siti Nor Shafika, 19, to her father about Basilan Island in the southern Philippines.
Siti Nor Shafika said this in a telephone call to her father recently to inform him of the difficult life she was experiencing on the turbulent island.
"She doesn't want me to go as it is very risky and shootouts often erupt," said Abdul Ghani Md Yasin, when met by Bernama in Taman Rinting near here recently.
He plans to go to Basilan Island because he fears for the safety of his second child, who was abducted by a Filipino more than a year ago.
Abdul Ghani, 45, a worker at a private company in Pasir Gudang near here, suspects that she has been charmed using black magic by the man known as 'Tontong' when they both worked at a factory in a nearby industrial estate.
Quoting sources, he said, his daughter who did not have an international passport, was believed to be in Barangay Kunhun Lenhuh, Municipal Al-Barka, Basilan Island.
The security on Basilan Island has been shaky following gun battles between the Philippines' military and groups such as Abu Sayyaf and splinter groups of the Moro Islamic Liberation Front.
Abdul Ghani fervently hopes the police or non-governmental organisations would help to bring Siti Nor Shafika home. To date, Abdul Ghani has lodged four police reports over her disappearance.
Recalling his daughter's missing in March last year, he said she left home with the clothes on her back without telling her parents her destination.
Later, he was informed by reliable sources that she had gone to Labuan, before going to Sabah and then to the southern Philippines via an illegal route.
Abdul Ghani also said 'Tontong' claimed he was from Sabah and used a fake identification card under the name "Mohd Nazirul Che Hassan".
He said Siti Nor Shafika called him recently and asked him to deposit RM1,000 via an international service into the account of one "Sahibil Abdul Najir Jikiri" on Basilan Island, to make an international passport.
"However, I did not do so until today, because when we were talking, I heard a voice directing her to ask me for the money," Abdul Ghani added.-Bernama

Datuk Seri Anwar Ibrahim will testify before the Royal Commission of Inquiry (RCI) probing the issuance of dubious ICs in Sabah next month where he will name three individuals responsible for "Project IC".

The Opposition Leader was today questioned on what he knew, and his role, in the controversial project during an interview session with the RCI investigating officer Supt Zainuddin Ismail behind closed doors at the PKR headquarters in Petaling Jaya.

Among others, Anwar was questioned on who else was involved in "Project IC" and what was the policy on the issue at that time.

Anwar left without speaking to reporters after the interview session but PKR Legal Bureau and Human Rights chief Latheefa Koya (pic) told reporters that the Opposition Leader will go before the five-man RCI panel in Kota Kinabalu next month to repeat what he told the investigation officer today.

She said Anwar will go to Sabah and expand on what he said because one of the interesting questions he was asked is what is his recommendation to resolve the problem of illegal immigrants there.

"Project IC which started much much earlier during the time of Tun Abdul Razak had gone on and continued until when Anwar was the deputy prime minister."

The RCI team is keen to know about Anwar's role and involvement in the project.

The BN government, which has controlled Sabah since 1963, has been accused of issuing citizenship and ICs to hundreds of thousands of foreigners in exchange for their votes during elections.

"This is not a preliminary meeting, this is an investigation to find out how much he knows, how much is his involvement before he is called in at the RCI. He has answered," Latheefa told reporters.

"He was also asked if he was directly involved and who was the person actually involved with regards to the issuance of the ICs.

"Briefly he has explained his role but some of the questions need further documentation which we will bring if we can because some may involve the Official Secrets Act."

She explained that in the past, Anwar had denied his involvement in "Project IC", but he had named three individuals who he alleged were involved.

Last month, Sabah Chief Minister Datuk Seri Musa Aman informed the five-man RCI panel, through his lawyer, that he was not involved in "Project IC".

This came about after a witness, former senator and state assemblyman Dr Chong Eng Leong, told the RCI that Musa chaired the "Project IC" taskforce in 1991 which was designed to register foreigners as Umno members after giving them citizenship.

Yesterday, Anwar said he was prepared to give full cooperation to the RCI panel in the interest of all parties, adding that his evidence revolves around only on what he knew during his tenure as deputy prime minister and finance minister.
