Sabah's locals 'immigrants' in their own land

Local Sabahan Bajau Encik Zaidi Atoh and other residents who are living in Kampung Likas, 10 minutes drive from Kota Kinabalu, said they felt like "immigrants in their own land".

Even the Muslim residents said they feared for their children's safety when these foreigners move into their villages turning the area as a hub for drug trafficking and smuggling.

At Kampung Air, a shopping area located in the heart of Kota Kinabalu, a local taxi driver told that their earnings are affected when these Filipino and Indonesian drivers appeared in the area.

In Keningau, two hours traveling distance, the locals have to compete with these foreign migrants for business spaces/slots.

According to local activists, this is the result of Project IC, identity cards given to illegal immigrants through illegal means thus making Sabah crowded with migrants. A testimony from last year's Lahad Datu intrusion of which many of the 'foreign militants or intruders' held Mykad.

The project started by Umno as a dirty election tactic aimed at changing the demographics of Sabah increasing the muslim illegal immigrants to the population level of 38%.

Foreigners with MyKad are now competing with locals for business licenses and permits. Locals also expressed their displeasure when these foreigners are willing to bribe the authorities.

Local activist Jalumin Bayogoh said if the issue was not addressed seriously, the tension could turn into violence.

Genuine IC, false citizenship 

The Royal Commission of Inquiry findings revealed that Project IC took place in the 1980s and 1990s during its hearing held in January 2013.

Witnesses who were called during the inquiry mentioned top politicians and civil servants involved during the era of the reign of Tun Dr Mahathir Mohamad.

Identity cards are simply given to Muslim immigrants, mostly from the Philippines and Indonesia without going through legal channels to gain citizenship.

Dr Mahathir in his testimony held that citizenship granted to Filipino immigrants in Sabah were done legally.

A book published by Sabah Reform Party (STAR), "Borneo Agenda" claims of about 300,000 foreigners received identification cards.

"Now, they may consist of millions of immigrants who obtained Malaysian citizenship through the back door," said the author of the book, Neston Joannes.

He quoted former Sandakan, Asainar MP Ebrahim @ Hassnar who admitted participating in the project IC.

Nestor wrote that the project caused Sabah's population increase to 302% between 1970 and 2000. In comparison, Sarawak has a population of more than Sabah in 1970 recorded an increase of 106% of the population in the same period.

He said, foreigners are given identity cards so they could vote in the election.

"To strengthen the dominance of Umno in Sabah, they use foreigners with given ICs to be supporters of the party."

Jobs and neighborhoods invaded 

Chong, a taxi driver for 12 years witnessed how the car rental industry in Kota Kinabalu slowly taken over by Indonesian immigrants.

"Now all airport taxi driven and managed by the Bugis. Many of those waiting at hotels and shopping centres," he said.

In fact these immgrants even have permits and their names appear on the cab door, said Chong and two other drivers and Sapri Ahmad who told The Malaysian Insider.

Ahmad said that to get a taxi permit, a person must have an IC, driving license and at least $15,000 in savings in the bank. They said foreigners may be willing to use the "back door" to obtain a permit. While the locals refused to pay bribes to obtain the license.

In addition to the loss of jobs and businesses are concerned, the people of Sabah also felt immigrants seize everything at their disposal.

Zaidi, who was head of security and the development of Kampung Likas (JKKK) said local residents are not comfortable with the placement of foreigners who build their bases for smuggling along the river near their village.

He said, the river became the centre for smuggling cooking oil, cigarettes and drugs because it was used as the exit or entry point into Sabah.

"They are aggressive and breaking laws and can easily escape by boat back to to their hometowns if the police are on their heels.

"In the village there are also fights using weapons such as machetes and swords involving immigrants and their enemies. However, there are no reports of local people involved in such incidents. But we live in fear every day. My friend said as if we are 'immigrants' even though in our own country."

A Malaysia problem

Local activists believe 64,000 Filipinos with refugee status in the 1970s, were granted citizenship.

Jalumin from Borneo Heritage Foundation, said these refugees should be given special passes that allow their residents to find work and send their children to school.

"But it does not give them the right to vote. When their children go to school, we can teach them respect and be loyal to the country. "

Sabah BN leader Jahid Jahim said what was more disturbing for the people in the state were foreigners who were loyal to the militants/terrorists outside Malaysia.

This was even more disturbing when they are ready to kill Malaysians when receiving instructions from their group.

Jahim said initially, the government must re-register each person in Sabah and give the new IC.

This will help isolate the Malaysians and migrants. He is echoing SAPP's inaugural call/proposal for Sabah IC in their manifesto to solve the illegal immigrants issue.

"This problem is not just a matter of Malaysia Sabah," he said, which is also the Sabah United Party information chief.

Restaurant director pays RM210,000 fine for harbouring illegals

KOTA KINABALU: A director of a seafood restaurant was fined a total of RM210,000, in default, 28 months’ jail by the Immigration Court here yesterday for allowing 28 illegal immigrants to remain in a restaurant.
Deputy registrar of the High Court, Hafizi Abdul Halim, who sat as a judge, imposed the sentence on David Lee Nam Lip, 36, who is the director of Gayang Seafood Restaurant Sdn Bhd, after he pleaded guilty to a charge under Section 55E (1) of the Immigration Act 1959/1963.
The indictment provides for a fine of between RM5,000 and RM30,000 or a maximum jail of 12 months or both for each illegal immigrant, upon conviction.
For each of the charges, the accused, who was represented by counsels Ram Singh and YS Lo, received a RM7,500 fine, in default, one month’s imprisonment for each immigrant.
In pleading for a light sentence, Ram urged the court to impose a minimum fine which is RM5,000 for each of the immigrants aged between 18 and 42 from the Philippines and Indonesia who were without valid travel documents or passes.
He also said the seafood restaurant had been around since 12 years ago.
In reply, Immigration Department prosecuting officer Shaiful Izuat Abd Shani applied for a deterrent sentence to be given to the accused to serve as a lesson and also to deter would-be offenders not to commit a similar offence in the future.
The accused paid the fine.
In a separate case, a restaurant owner received a total of RM45,000 fine, in default, six months’ jail for committing a similar offence.
Noorsaliha Agusalim, 24, was fined RM7,500, in default, six months’ jail after she pleaded guilty in the same court to allowing six illegal immigrants, aged between 11 and 15, to remain in her restaurant at Sulaman Central, Jalan Sepanggar in Menggatal on April 28.
The accused, who was defended by counsel Jahara Patimbang, applied for the payment of the fine be paid in two installments.
However, the court said the payment of fine must be made all at once on the chief registrar’s instruction.
In mitigation, the counsel said her client was still new in this field and she did not understand about workers’ documentations when those immigrants came to her premises to ask for work.
Meanwhile, Ernie Marlina Mohammad, 35, was fined a total of RM15,000, in default, two months’ jail for allowing two illegal immigrants to be in a premises. She was arrested at Karamunsing police station on May 25.
The court ordered all the accused persons’ bail to be refunded.

Harris wins accusation over blue Ics

Kota Kinabalu: Former Chief Minister Tan Sri Harris Salleh won a defamation suit against politician Dr Chong Eng Leong who had claimed that Harris was involved in the issuance of blue ICs to foreigners in Sabah.
High Court Judge Ravinthran Paramaguru on Tuesday awarded Harris RM100,000 in damages. He also ordered Dr Chong to pay RM50,000 in costs to Harris.
It was the second time that Harris has won RM100,000 damages in a defamation suit. A similar award in 1982 against a Sabah politician when he was the Chief Minister was channeled towards enhancing local journalism standards through the setting up of the Berjaya Foundation.
It was also the second court victory for Harris within 48 hours.
On Monday, High Court judge here, Justice Chew Soo Ho, ruled in his favour in a suit brought against him by a businessman that Harris' handing over of Labuan to the Federal Government in 1984 was unlawful.
Harris was awarded RM15,000 in costs against James Albanus.
Harris had sought RM50 million in damages against Dr Chong for allegedly defaming him in a Daily Express report published on July 17, 2012.
He was seeking an injunction to restrain Dr Chong, whether himself or his servants and/or employee or agents, from printing and publishing further statements and/or similar libel on him in any form. Ravinthran held that Dr Chong had failed in all his defences against the libel claims.
In his ruling, Ravinthran said there were two main defamatory grounds and the first was the ground of qualified privilege.
He said there was duty on the press to receive information but it was left to the public authority to investigate the information and not the press as public interest was involved.
"Therefore plaintiff must be given an opportunity to respond É there was no attempt to communicate before publication and in my opinion I find that this is not reasonable. The defendant was not the press and I find that the qualified privilege had failed," he said.
Ravinthran said the second ground was about the issuance of fraudulent ICs where the court considered the witnesses who had given evidence -the defendant himself (Dr Chong), one Haji Ansari, the late Abdul Mutalib Mohd Daud, Hassnar MP Ebrahim and (Daily Express Chief Reporter) Chris Maskilone but only one witness had given alleged direct evidence on Harris' involvement in the issuance of fraudulent Ics.
"Hassnar had admitted serious wrongdoing on his partÉ however I treat his evidence with caution because his relationship with the plaintiff had gone bad over the years."
Harris was represented by counsel Sonny Durai and Chin Yuen Fong and Dr Chong by counsel Marina Tiu.
Tiu said they would file an appeal against the decision to the Court of Appeal. During the judgment, only Dr Chong was present in court.

Govt asked to declare war on armed intruders

KOTA KINABALU: Several leaders in Sabah have called on the government to declare war against those responsible for the death of marine police corporal, Rajah Jamuan, during an ambush by a group of armed men at Mabul Water Bungalows Resort in Pulau Mabul, Semporna on Saturday night.
His colleague constable, Zakiah Aliep, 26, was reported as missing and is believed to have been kidnapped by the marauders.
Liberal Democratic Party (LDP) president Datuk Teo Chee Kang, when asked to comment on the latest incident, said that he viewed the attack as a challenge on the Malaysian security forces.
“This is a very serious encroachment into our territory. It is a very serious breach and I urge our enforcement personnel, especially our police force, to declare war against these people. We must put up a very strong front against all intruders and together we must guard our boundary as well as defend our sovereignty,” the Minister of Special Tasks stressed.
“I wish to extend my deepest condolences to the family of the police personnel who sacrificed their lives to defend our country and the safety of the people and their property. I hope the spirit of our security forces, especially the police force, will strengthen by this tragic incident. We must stand together to fight this war against people who encroach into our country,” he said.
On the issue of people putting the blame on illegal immigrants who obtained Malaysian citizenship and identity cards dubiously, for the intrusions, Teo said he believes the Royal Commission of Inquiry (RCI) on the presence of illegal immigrants in Sabah had looked into the matter comprehensively.
“The RCI, I believe, would have already looked into this very comprehensively. Its report has already been submitted to the government. However, to date the report has yet to be revealed. We just have to give a little more time for that and I am sure there will be recommendations, suggested by the RCI panel and we will go from there,” he said.
When asked if he supports the suggestion by former UPKO president Tan Sri Bernard Dompok that all identity cards issued in Sabah be recalled and re-issued only to genuine Sabahans, Teo replied: “If indeed there are ICs which were dubiously obtained by the illegal immigrants then we have to do something to cancel them. If there is evidence that can prove the ICs were obtained dubiously, then I would support the move.”
Meanwhile, DAP Sabah chairman Jimmy Wong also rallied on Sabahans to rise up and declare war against the intruders for taking the life of a policeman.
“Today, we lost a young and bright soul, a patriotic servant who served this country and state that we all love with pride and bravery. We owe it to him to make sure that his sacrifice will not go in vain.
“We, the people of Sabah, the citizens of this country, should rise up. It’s time to rise above partisan politics and unite as a nation, to stand up and say enough is enough and it’s high time to defend our sovereignty. It’s time to strike back. For what they have done to us last night … this means war!
“I call upon the Prime Minister and the Minister of Home Affairs to file an emergency motion. Our troops were shot at and abducted. This is serious. This is a national security crisis, and we, in the opposition, are ready to work with the government to take on this issue swiftly.
“I strongly urge the PM to call for an emergency Parliament session, allow representatives from both the BN and PR to discuss the solution and face the challenges ahead. It’s high time for BN and PR politicians to put aside our differences and unite for a national cause,” the Kota Kinabalu member of parliament said.
Jimmy stressed that the situation is serious as the country’s sovereignty is at stake and the intruders have come in and out of the state like it’s their own playground.
“We must make a stand. We must strike back. We may have our political differences in the past but at times like this is where we should unite like what Abraham Lincoln once said: “We are not enemies, we must not be enemies; though passion may have strained, it must not affect our bond of affection”.
“And, that common affection is Our People. Our security is at stake, the people of this beautiful state don’t deserve to live in fear. But instead, it’s time to strike fear back into our enemies’ heart, to make a loud and clear statement that we will not tolerate our people from being kidnapped/tortured/shot at, let alone our troops. This should be the true spirit of patriotism.
“To Datuk Seri Najib, they attacked us while you were leaving Sabah last night. They are provoking you, and they have drawn first blood. So I call upon the Prime Minister, who also is our commander-in-chief, to lead. And when you do, I assure you, the rest of us will follow suit. Be a man, do the right thing, and solve this once and for all!” Jimmy said.
