Scathing attack on Chief Justice over remarks on Pakistanis: Ex-MP comes under fire Published on: Monday, March 30, 2015 http://www.dailyexpress.com.my/news.cfm?NewsID=98480 Kota Kinabalu: Former Member of Parliament Datuk Akbar Khan Abdulrahman has come under fire for his scathing attack on the Chief Justice of Sabah and Sarawak Tan Sri Richard Malanjum over the latter's statement asking the authority to check the documents of every Pakistani in Sabah. "The attack by Akbar on the Chief Justice of Sabah and Sarawak is uncalled for and is tantamount to an attack on the judiciary in carrying out their judicial and constitutional duty," said Sabah Reform Movement Chief Datuk Wilfred Bumburing. He said Malanjum's remarks reflected the long-standing sentiment of the genuine people of Sabah. "For so long the State of Sabah has been flooded with people from Pakistan. It's a common site in the rural areas where these people are going around selling textiles, initially on their motorcycles and later driving cars. "A lot of them are later known to flash their 'fresh-from-the-oven' Malaysian Identity Cards (ICs)," he said here, Sunday, adding that constant unanswered questions from the locals were how did these foreigners get their trading licences and eventually ICs. "I welcome the remarks by Malanjum as it struck the nail right on its head in as far as this issue is concerned," said Bumburing, who is also Tamparuli Assemblyman. On Akbar's remarks citing Malanjum as being racist, Bumburing said: "I would say that Akbar should be smart enough to understand that what the Chief Justice meant is not directed at any race including those of Pakistani decent. "Malanjum clearly referred only to the Pakistani nationals who came to Sabah so easily and in growing numbers in recent years. It is not about race but foreigners who flooded the State," he said. Bumburing said the Royal Commission of Inquiry showed the culmination of Sabahan's utter disgust on illegal immigrants in Sabah. Illegal immigrants in Sabah were made up of many nationalities – Filipinos, Indonesians, Indians, Pakistanis, Chinese and others. Of course at the time of independence of Sabah on the Aug 31, 1963, the population of Sabah was multiracial which included those of non-Sabahan origin such as Chinese, Europeans, Australians, Indonesians, Filipinos, Indians, Pakistanis, Malays from Malaya and many others. In the independence agreement those who resided in Sabah prior to the independence date have the right to choose to be citizens of the newly born nation state of Sabah. Subsequently, the children of these people are Sabahan in all their rights and nobody can question them. "In as far as I am concerned, though there are not native to Sabah, I consider them 'orang asal' Sabah. "I reject the call of the Umno leaders in Malaya which brand them as 'pendatang'. They are different from the illegal immigrants who flooded Sabah in recent years, thanks to the 'courtesy' of the Government," said Bumburing. To solve the illegal immigrants problem, Bumburing welcomed the call by Malanjum for comprehensive checks to be done on illegal immigrants, not only those from Pakistan but from other countries. Therefore, he said, the call by Akbar Khan for the Chief Justice of Sabah and Sarawak to apologise was utterly unwarranted. "Akbar said he is a loyal Malaysian citizen and being a Sabahan he should fight for the sovereignty of Sabah," he said, adding that genuine Sabahans have for so long demanded for action to be taken on the illegal immigrant issue. "Now a Chief Justice has called on the Government to act and his directive must not be swept under the carpet. "The arrest and conviction of the eight immigration officers is only the tip of the iceberg. The revelation on the existence of false ICS in Keningau tells tales. "I was informed about a report in the social media that a rented house in Tuaran had been used to issue false birth certificates and ICs. "I believe that if all the foreigners who possess fake ICs and birth certificates in Sabah are apprehended, the whole prisons facilities in Malaysia will not be sufficient to house them," he said. The arrest of cartoonist Zunar and Datuk Anwar Ibrahim's lawyer N Surendran for opining on the judiciary and the likely detention or questioning of Christopher Leong for the same and many others to have all been linked to an alleged act of sedition. He believed that it was Akbar Khan's prerogative as a citizen to make a fair opinion and hence, "this is why we have always uphold the freedom of expression albeit the authorities have taken a differing opinion." But, on the other hand, Akbar Khan may have misunderstood on what Malanjum had opined in. "In my opinion, Akbar Khan had gone overboard in his explanation and demands over the remarks by a judge during a court proceeding and which remarks resonate the people's feeling today in Sabah. But then again it is his (Akbar Khan) right to opine," he said. "However, and in light of circumstances lately in the Federation of Malaysia, I now challenge the police to investigate if the remarks or front page outrage by Datuk Akbar Khan over Tan Sri Richard Malanjum falls on the same so-called 'seditious' remarks as were Zunar, N. Surendran, Chris Leong and many others since these guys were hauled up by the police and are charged for questioning the judiciary/judges as well and the police had acted on them as they were deemed seditious by the police. "I am all for freedom of expression and the rights to an opinion but would the same initiative for investigative standards apply to Datuk Akbar Khan considering his statement today (Sunday)?" he asked. "Or would the IGP want to wait for a police report before investigating, detain and question Akbar Khan? Would the police be applying the same standards done against Zunar, N. Surendran and others or is there a different standard applicable?" he asked. Akbar Khan, in demanding for an apology from Malanjum, also accused him of being a racist. If he refused to apologise, Akbar Khan said Malanjum should resign "to save the judiciary from further contempt and ridicule.

Loopholes at Menumbok, Jesselton Point Published on: Saturday, March 28, 2015 Kota Kinabalu: The unexplained increasing presence of Pakistani nationals in the State has been debated for several years now and many Sabahans viewed them suspiciously until the Chief Judge of Sabah and Sarawak Tan Sri Richard Malanjum finally asked the same question. "Are these 'Pakistanis' in possession of genuine travel documents or passports and if not, how did they manage to enter the State?" asked Penampang MP Darell Leiking. He said in 2013, he asked the Home Minister about the absence of immigration checkpoints at Menumbok and Jesselton Point jetty so as to ensure that only those with valid travel documents or passports traveling by ferry from Labuan will be allowed to land and pass the guard post or Customs checks before proceeding to other districts in the State. "The Home Minister in his reply confirmed that there were no necessity for immigration inspection as the Home Minister's Directive gazetted on July 26, 1984 and the Malaysian Immigration Circular dated July 27, 1984 provides for automatic exemption to anyone (including foreigners) from having to produce his/her valid travel documents or passport when entering Sabah from Labuan. "Consequent to these directive and circular, travellers from the peninsula (irrespective of whether they are Malaysian citizens or not) will only need to take a flight from any airport in the peninsula, land at Labuan airport, board the ferry to Menumbok or Jesselton Point and thereafter, proceed to other parts of Sabah freely without producing any valid travel documents or passport at any immigration checkpoint. "In fact, any domestic destination except Sabah and Sarawak requires no production of identity cards but of course, for entrants coming from Labuan to Menumbok or Jesselton Point Jetty pursuant to the directive and circular issued in 1984 need not produce any documents," he said. This 'Menumbok and Jesselton Point Loophole', said Leiking contradicts the immigration sovereignty currently practiced by Sabah when non-Sabahan or Malaysian air travellers will have to produce their passports at the airport immigration checkpoints all over Sabah before being allowed to enter the State. "Hence the paradox is anyone coming by air travel from Labuan will still register their entry if they enter Sabah at the airports but not if they entered through Menumbok or Jesselton Point jetties. How does one comprehend that?" he asked. Leiking continued that Sabah's founding forefathers knew it beforehand that Sabah must have its full power over regional immigration sovereignty to prevent massive influx of immigrants, either from within Malaysia or outside, from entering the State. During that time, he said the immigration safeguard was intended to protect the locals from being displaced in terms of socio-economic progress by immigrants, especially from Singapore and Malaya and also to protect the State's massive natural resources from being exploited by non-Sabahan corporations. "The nonchalant attitude shown by the BN-led Sabah Government over the Menumbok and Jesselton Point loophole is saddening. "This is the clear evidence of its failure to protect our safeguards, privileges and interests contained under the spirit and letter of the Malaysia Agreement 1963 and all the preceding documents agreed to by all the relevant parties prior to the formation of the Federation of Malaysia," he said. He said it is interesting to point out that one of the five Pakistani citizens charged with fake travel passes namely Ibrar Khan Ibrahim Khan had told Malanjum during the proceeding that he intended to get out from Sabah via Menumbok-Labuan. "This clearly shows that Menumbok is being exploited by foreigners such as Ibrar to enter or to come out from Sabah since there is no immigration checkpoint at that place. "Further, if he is all the while of full knowledge that his travel document is fake, he would not produce such document for inspection at any immigration checkpoint that conduct stringent examination of travel documents. "It now begs us to the think as how many foreigners are there in possession of fake travel documents or passports who managed to slip into Sabah via the Menumbok and Jesselton Point loophole," he said. Leiking stated if it is due to local human trafficking syndicate as stated by the Deputy Home Minister Datuk Seri Wan Junaidi Tuanku Jaafar, then over the period of several years, the Menumbok and Jesselton Point loophole may have allowed tens of thousands of foreigners with fake travel document or passport or worse, without any travel document at all to enter Sabah. "So, the call by Malanjum is wholeheartedly supported by all Sabahans and it is only apt that the Immigration Department together with the State Government immediately screen all Pakistani citizens in the State along with other immigrants if they are indeed in possession of genuine travel documents or not. "Thereafter, they must also set up an immigration checkpoint at Menumbok and Jesselton Point without any further delay," he said. No problem re-issuing ICs: NRD Published on: Saturday, March 21, 2015 Daily Express Kota Kinabalu: The National Registration Department (NRD) in Sabah has all the resources needed, including manpower, should the Government decide to recall and reissue all ICs in the State. "Nothing has been decided but if it comes to that, we will be ready. It is possible and can be done," said its Director Ismail Ahmad (pic), Friday. He added that the department has all the information needed to execute the exercise and all 29 branches statewide are adequate enough to carry out the verification of ICs. "Of course it will mean extra work for us but I believe the Government will know what to do. They will have the mechanism in place on how that can be done. We in the NRD in Sabah, we have enough people. "For now, we just have to wait and see what the Royal Commission of Inquiry (RCI) on Illegal Immigrants in Sabah committee decides to do," he said. Asked about the possibility of a Sabah IC as suggested by some quarters, Ismail felt all Malaysians should have one type of IC only which is the Malaysian IC. "Anyway, we only receive orders. It is better to adopt a wait and see position right now. Whatever the suggestion, we will implement." Meanwhile, Ismail clarified that only foreigners who have stayed in Sabah for more than five years are eligible for Permanent Resident (PR) status and only PR holders who have stayed here continuously for 12 years would be considered for citizenship. He also stressed that the department no longer accepts Statutory Declaration letters and only refer to birth certificates. However, there are exceptions for some people who wish to get the MyKad. "If the applications are accompanied by letters from the Home Ministry, then NRD is obliged to issue MyKad to these applicants. That is our procedure," he said. Commenting on foreigners who hardly speak Malay and still retain their culture from their country of origin but are in possession of genuine ICs, Ismail said it is difficult to accuse these people of obtaining their IC through dubious means. "How can we say they have not stayed here for more than 12 years as required because sometimes, even our natives can't speak proper Malay. "I am aware that people are saying these people have just arrived here a few months and suddenly they have ICs. But if you have proof of these accusations, I welcome you to come forward and report to the police and NRD," he said. Meanwhile, Ismail also denied that Keningau has the most number of foreigners possessing fake MyKads or ICs. "In fact, all districts have the problem but the department could not give the exact number as these MyKads were produced by syndicates. "I admit, years ago, many MyKads were issued to foreigners by NRD resulting in 22 officers being detained under the Internal Security Act (ISA) and all the MyKads have been cancelled. "However, what is happening today is different because these MyKads are fake. They look similar but they are not the same. I don't know what type of machine was used to produce these, where and how they did it," he said. Last month, he said, a foreigner was arrested after attempting to use a fake MyKad to apply for a passport but was caught because the Immigration's system is linked to NRD and it was found that the chip in the MyKad was empty. Investigation revealed that the culprit paid RM8,000 for the fake MyKad but he could not pinpoint the real mastermind behind the syndicate because of too many middlemen. He said Ismail said NRD is cooperating with the police in tracking down the type of machine used to produce the fake MyKad. "But no matter how sophisticated the machine is, it still cannot fully imitate the end product produced by NRD because we have security features in the chip. The fakes' chips are empty and when we check with our system, they cannot produce the data," he said. Deputy Chief Minister Tan Sri Joseph Pairin Kitingan, who is Keningau MP, had expressed dismay over a report that Keningau had the highest number of foreigners with fake ICs. Ismail said he had already spoken to Pairin and showed him the fake ICs. "He was surprised of course. The fakes look very similar, with the chips in place. They not only imitate the blue MyKad, even red MyKad is not spared. For genuine ICs, if you run it through UV light, you will see all the security features. These fakes are empty. "Even through naked eyes, you can tell they are fakes. The colour is a bit off, the fonts look different and the printing is unusual," he said. Ismail added that this year alone, the department had detected six people in possession of the fake ICs. All six were arrested in Kota Kinabalu. He said the problem is not unique to Sabah because there have been many instances where fake ICs were detected in the peninsula also although the carriers would usually have Sabah as their addresses. Reminding the public about the bank security guard in KL who robbed the bank he was supposed to protect and killed a woman bank officer, Ismail advised potential employers to verify all ICs with the department if they are suspicious about the authenticity of the ICs of jobseekers. "We do not know these people's agenda. They could even be spies for their people back in their countries of origin. We are afraid of this. "Not only that, the government will lose out on levies because these people will skip the work permits and work illegally. Imagine the amount of losses we are are incurring. "Before you employ, be cautious. We Sabahans can know instinctively through their accent. If their ICs look suspicious, inform the department immediately." A crackdown aimed at holders of the fake ICs, he said would be fruitless because these people are also victims although the authority will continue to round them up in integrated operations. Ismail said the authority is working hard to gather intelligence to identify the real masterminds behind the syndicate and bring them to justice. It could not be ascertained however whether the syndicates are based in the State or in other states or even outside the country.
